ACTIONS TO INCREASE ATHLETIC OPPORTUNITIES. If through the above-described assessment, the District identifies a sport or sports in which there is sufficient but unmet interest and, if applicable, ability of female students to participate at the interscholastic level at a particular high school, the District will add athletics opportunities as described below at the high school(s) until such time as either (1) the high school is fully and effectively accommodating the expressed interests and abilities of female students (i.e., there remains no unmet interest and ability); or (2) the participation rate for female students in the high school’s interscholastic athletics program is substantially proportionate to their rate of enrollment at the high school. For purposes of this provision, “sufficient interest” is defined as the minimum number of athletes needed to support a team. For “sufficient ability,” it is sufficient that interested students and admitted students have the potential to sustain an interscholastic team and students will not be required to demonstrate they have sufficient ability in a new sport or team if students participating in existing sports or teams are not required to demonstrate through try-outs or some other process that they possess sufficient ability to participate in the specific sport or at the particular level of competition (varsity, junior varsity, etc.) in which they have expressed interest. In providing additional athletic opportunities for female students to either accommodate their expressed interests and abilities or until their rate of participation is substantially proportionate to their rate of enrollment at each subject school, the District shall do the following:
ACTIONS TO INCREASE ATHLETIC OPPORTUNITIES. If the University believes that it will be unable to demonstrate compliance pursuant to section I of this Agreement, then the University will submit to OCR by December 1, 2020, its detailed plan with timeframes to effectively accommodate the interests and abilities of the underrepresented sex to the extent necessary to provide equal opportunity in its intercollegiate athletics program by the 2021-2022 academic year, including the steps noted below:
ACTIONS TO INCREASE ATHLETIC OPPORTUNITIES. Reporting Requirements In accordance with the Timetable set in Section I, the College will provide to OCR for its review and approval a copy of its detailed report that includes information and supporting documentation demonstrating the plan required above will effectively accommodate the interests and abilities of members of both sexes. The plan will include a description of the interim steps that will be taken by the College during the 2016-17 and 2017-18 school years to increase intercollegiate athletic opportunities for the underrepresented sex. In accordance with the Timetable set in Section I, and by the same dates annually thereafter, the College will provide OCR status reports regarding its implementation of its plan to effectively accommodate the interests and abilities of members of both sexes including, as applicable, information demonstrating that a coaching staff has been hired for any new teams being added by the College, an update on the College’s progress in recruiting student athletes for the added teams, and a copy of the detailed budget provided to the teams to ensure they are able to begin competition during the 2018-19 school year. The status reports will also include documentation regarding the interim steps taken by the College to increase intercollegiate athletic participation opportunities for women during the 2016-17 and 2017-18 school years. In accordance with the Timetable set in Section I, and by the same date annually thereafter, the College will provide OCR, for OCR’s review and approval, a report that includes information demonstrating that its intercollegiate athletics program equally effectively accommodate the athletic interests and abilities of its female students.
ACTIONS TO INCREASE ATHLETIC OPPORTUNITIES. If, by January 30, 2018, the University is wholly unable to demonstrate compliance with Title IX pursuant to sections I.A. or I.B. of this Agreement, the University will submit to OCR for review and approval its detailed plan with timeframes to effectively accommodate the interests and abilities of the underrepresented sex to the extent necessary to provide equal opportunity in its intercollegiate athletics program by no later than the 2018-2019 academic year, including the steps noted below. In addition, the plan will include a description of interim steps that have been or will be taken by the University during the 2016-2017 and 2017-2018 academic years to increase intercollegiate athletic participation opportunities for women. The University will begin implementation of the plan within 30 days of OCR’s approval.

By July 30, 2018, if the District is unable to demonstrate compliance pursuant to Section I, Parts 1, 2 or 3 of this Agreement, the District will identify whether or not the High School is in compliance with any part of the three-part test and will take the following steps:

If through the above-described assessments, the NYCDOE identifies a sport or sports in which there is sufficient but unmet interest, and if applicable, ability of female students to participate at the interscholastic level at a particular high school, the NYCDOE will continue to add athletic opportunities as described below at the high school(s) to meet the expressed interests and abilities of female high school athletes or to achieve a participation rate for female students that is substantially proportionate to their rate of enrollment. For purposes of this provision, “sufficient interest” is defined as the minimum number of athletes needed to support a team. For “sufficient ability,” it is sufficient that interested students and admitted students have the potential to sustain an interscholastic team. In providing additional athletic opportunities for female high school students to either accommodate their expressed interests and abilities or until their rate of participation is substantially proportionate to their rate of enrollment at NYCDOE high schools, the NYCDOE shall do the following:

If, by May 1, 2020, the District is wholly unable to demonstrate compliance with Title IX pursuant to sections II.A. or II.B. of this Agreement, the District will submit to OCR for review and approval its detailed plan with timeframes to effectively accommodate the interests and abilities of the underrepresented sex to the extent necessary to provide equal opportunity in its interscholastic athletics program by no later than the 2020-2021 academic year, including the steps noted below. In addition, the plan will include a description of interim steps that have been or will be taken by the District during the 2019-2020 and 2020-2021 academic years to increase interscholastic athletic participation opportunities for girls. The District will begin implementation of the plan within 30 days of OCR’s approval.
ACTIONS TO INCREASE ATHLETIC OPPORTUNITIES. The University will take the following actions only if unable to demonstrate current compliance with Title IX pursuant to Section I.A of this Agreement:

Commitment: In accordance with the Timetable set in Section I, if the College is unable to demonstrate compliance pursuant to Section III(7)(C), Part I - Substantially Proportionate Participation Opportunities, the College will submit its detailed plan with timeframes to effectively accommodate the interests and abilities of female students to the extent necessary to provide equal opportunity in its intercollegiate athletics program by the 2018-19 school year. The College’s detailed plan will include the steps noted below. In addition, the plan will include a description of interim steps that will be taken by the College during the 2016-17 and 2017-18 school years to increase intercollegiate athletic participation opportunities for female students. The College also agrees to conduct periodic assessments of the athletic interests and abilities of its students and admitted students in subsequent years to ensure it is equally and effectively accommodating the athletic interests and abilities of its male and female students consistent with Title IX and its implementing regulation. The College will begin implementation of the plan approved by OCR within 30 days of OCR’s approval.
