Section 3.5. 45 Neither the District, nor the Association, shall discriminate against any employee subject to this 46 Agreement on the basis of race, creed, color, sex, religion, age or marital status or because of a physical 1 handicap with respect to a position, the duties of which may be performed efficiently by an individual 2 without danger to the health or safety of the physically handicapped person or others.

Section 3.5. 44 Each employee reserves and retains the right to delegate any right or duty contained in this Agreement, 45 exclusive of compensation for services rendered, to appropriate officials of the Association.

Section 3.5. 44 An employee who transports school district funds from the Educational Service Center to a financial 45 institution shall be held harmless from liability for such funds provided the employee exercises 46 reasonable care of such funds and is not fraudulent or negligent in regard to the funds.
Section 3.5. 37 During the term of this Agreement, the Union and its members, as individuals or as a group, will not 38 initiate, cause or participate in any strike, work stoppage, slowdown, or any other restriction of work 39 against the District, and will discourage any such activity. Section 3.5. 37 Employees will be given a copy of all material added to the central office personnel file at the time such 38 material is added to the file. Each employee will have the right, upon request to the Superintendent's 39 secretary, to schedule an appointment to review the contents of their personnel file. Three (3) years from 40 the date of the disciplinary letter, employees may request, in writing, to the Superintendent, the removal 41 of such material from the employees’ personnel file. The Superintendent will review and respond to the 42 request in writing within thirty (30) days. The decision to expunge documentation will be based on 43 the nature and severity of the misconduct. 45 An employee may obtain copies of the documents made available under this section. Except to the 46 extent required by the Public Records Act, no record, file or document pertaining to an employee will be 47 made available to any unauthorized person for photocopy or inspection. Employees shall have the right 1 to respond in writing to all additions in the personnel file.
