Common use of Section 3.5 Clause in Contracts

Section 3.5. 45 Neither the District, nor the Association, shall discriminate against any employee subject to this 46 Agreement on the basis of race, creed, color, sex, religion, age or marital status or because of a physical 1 handicap with respect to a position, the duties of which may be performed efficiently by an individual 2 without danger to the health or safety of the physically handicapped person or others.

Section 3.5. 45 29 Neither the District, nor the Association, shall discriminate against any employee subject to this 46 30 Agreement on the basis of race, creed, color, sex, religion, age or marital status or because of a physical 1 handicap 31 disability with respect to a position, the duties of which may be performed efficiently by an individual 2 32 without danger to the health or safety of the physically handicapped disabled person or others.

Section 3.5. 45 22 Neither the District, nor the AssociationUnion, shall discriminate against any employee subject to this 46 Agreement 23 on the basis of race, national origin, language, creed, color, sex, religion, age age, sexual orientation, 24 gender identity or expression, marital status or because of a physical 1 handicap disability with respect to 25 a position, the duties of which may be performed efficiently by an individual 2 without danger to the 26 health or safety of the physically handicapped disabled person or others.

Section 3.5. 45 28 Neither the District, nor the Association, shall discriminate against any employee subject to this 46 29 Agreement on the basis of race, creed, color, sex, religion, age age, sexual orientation or marital status or 30 because of a physical 1 handicap with respect to a position, the duties of which may be performed 31 efficiently by an individual 2 without danger to the health or safety of the physically handicapped person 32 or others.

Section 3.5. 45 6 Neither the District, nor the Association, shall unlawfully discriminate against any employee subject to 7 this 46 Agreement on the basis of race, creed, color, sex, religion, age or marital status or because of a physical 1 handicap 8 disability with respect to a position, the duties of which may be performed efficiently by an individual 2 9 without danger to the health or safety of the physically handicapped disabled person or others.

Section 3.5. 45 28 Neither the District, nor the Association, shall discriminate against any employee subject to this 46 29 Agreement on the basis of race, creed, sexual orientation, color, sex, religion, age or age, marital status or 30 because of a physical 1 handicap with respect to a position, the duties of which may be performed 31 efficiently by an individual 2 without danger to the health or safety of the physically handicapped person 32 or others.
