Section 9.8. 23 The District shall publicize within the bargaining unit for five (5) working days the availability of open 24 positions as soon as possible after the District is apprised of the opening. An open position is defined as any 25 position covered by this Agreement which is new or has become vacant because of transfer, resignation, 26 termination, leave of absence, or death; provided, the District determines to fill such open position.
