Promotional Purposes definition

Promotional Purposes means the promotion by or on behalf of SCT on its website, the Platform and elsewhere of the work SCT carries out and the Objective, including the promotion of the Club, the Network and the alumni network (as defined in the Collaboration Agreement), including but not limited to by way of publication of Club Material in promotional films, brochures, campaigns or other promotional material. SCT: as defined in the Collaboration Agreement. SCT Marks: means the name, logo and / or related trade or service marks of SCT, whether registered or unregistered, including those set out in Schedule 1 to the Collaboration Agreement.
Promotional Purposes in the sections above do not include any statements comparing either party’s products and services to the other’s, whether or not the other party is explicitly mentioned, and the parties expressly agree not to use any data generated hereunder for any such purpose. Nothing in this Section 2.4 shall limit either party’s rights with respect to any data or information to which it has any rights acquired independently of this Agreement.

More Definitions of Promotional Purposes

Promotional Purposes means the promotion by or on behalf of SCT on its website and elsewhere of the work SCT carries out and the Objective, including the promotion of the Club, the Network and the alumni network (as defined in the Background above).
Promotional Purposes means use of data from the Celebrex Comparator Sub-Study under the following circumstances: (i) the results of the Celebrex Comparator Sub-Study have demonstrated [**] study) and (ii) ALPHARMA takes affirmative steps either (A) to use such positive results to obtain Approval for Diractin or to obtain an improved label for Diractin, as demonstrated by ALPHARMA providing FDA with statistical analyses of such positive results to obtain such Approval or improved label beyond providing such statistical analyses as are required by applicable law or regulation applicable to the submission of data to FDA in support of an NDA or as are reasonably required to respond to any request made by FDA without prompting by ALPHARMA or (B) to use such positive results to promote Diractin, as demonstrated by any promotional use of such positive results that is not required by applicable law or regulation; provided that IDEA shall have the burden of proving the existence of the circumstances set forth in the foregoing clauses (i) and (ii). Notwithstanding the foregoing, use for any purpose by ALPHARMA of [**]) from the Celebrex Comparator Sub-Study and use for any purpose by ALPHARMA of data regarding the maintenance of treatment effect after discontinuation of use for Diractin (i.e., such maintenance of treatment effect data for Diractin [**]) from the Celebrex Comparator Sub-Study, in each case shall not constitute use for Promotional Purposes.
