The existing static advertising sign existing on the Property as of the date hereof shall be removed prior to or concurrently with the erection of the Permitted Sign.
The parties acknowledge and agree that nothing in this Agreement serves to impair, limit, or diminish the City’s police power authority and discretion to consider and act upon applications for development projects, including projects in the public right- of-way, in the vicinity of the Property, and, that this Agreement does not confer upon the Owner a right to an unobstructed view of the Permitted Sign.
The “City Content Allocation” shall mean a maximum period of time equal to seventeen and one-half (17.5) percent of the total annual operating time for the Permitted Sign.
Owner shall not remove or cut any tree located on a property adjacent to the Property that is not owned by Owner to remove obstruction to the Permitted Sign.
Owner shall be granted an annual capital expense credit against the Public Benefit Payment in each of Years 1 through 8 for the costs incurred (whether incurred by Owner or Tenant) for the capital expenses from construction of the Permitted Sign, tenant improvements, and other obligations as part of subsections 4.2 through 4.5. The costs may include the cost of construction of the Permitted Sign throughout the Term of the Agreement.
