Processing Fees. 8.1 Merchant will pay Processing Fees in the amount specified in the FEE SCHEDULE attached to the Application or as otherwise provided for in this Agreement as amended from time to time. Provider may revise the Processing Fees by giving Merchant fifteen (15) days advance notice effective for Transactions and Credit Vouchers submitted on and after the effective date of the change. Provider will not be required to provide the Merchant with fifteen (15) days’ notice of any changes in Processing Fees in the event that any Card Network, or any other entity having such authority revises the Processing Fees and the effective date for implementation of the revision in the Processing Fees is less than fifteen

In such cases, the Bank shall make reasonable efforts including, but not limited to, written correspondence, notification on statements, website notification, email, fax or direct contact via the telephone or otherwise, to provide reasonable notification to Merchant. However, failure to provide advance notice of the increase in Processing Fees will not affect Merchant’s obligation to pay the increased Processing Fees. The increase(s) in Processing Fees shall be effective on the date specified by Bank. Merchant’s submission of any Charge to Bank after receiving notice of a change in the Processing Fees shall constitute Merchant’s agreement to the new Processing Fees. Processing Fees and other service charges or amounts owed by Merchant to Bank, including for Chargebacks, anticipated Chargebacks, Credit Vouchers, Processing Fees, and any other fees owed, fines, penalties, loss allocations, damages, expenses (including, without limitation, attorneys’ fees, investigatory and/or remediation expenses), charges, assessments, registrations, certification expenses, payment obligations owed by Merchant to Bank under this Agreement (including, without limitation, indemnity obligations), and any and all or other amounts due Bank, the Card Networks, or any governmental, banking, or regulatory agency, or claimed by third parties, arising out of this Agreement or involving Merchant’s business, actions, omissions, or use of the services contemplated under this Agreement, may be deducted by Merchant Bank from amounts due Merchant, or from the Settlement Account or from the Reserve Account without prior notice needed to Merchant. Processing Fees. For three (3) years following the Effective Date, as extended by the number of days in any extension of the Term under Section 10.6.1, Processing Fees for the Near-Term Projects shall be limited to the Processing Fees in effect, on a City-Wide basis, as of the Effective Date (provided that to the extent Processing Fees are based on time and materials costs, such fees may be calculated based on the schedule for time and materials costs in effect on the date the work is performed by the City). Thereafter, Processing Fees for the Near-Term Projects and Long-Term Projects shall be limited to the Processing Fees in effect, on a City-Wide basis, at the time that CPMC applies for the permit or approval for which such Processing Fee is payable in connection with the applicable portion of the Long-Term Project.

Processing Fees. A nonrefundable Processing Fee, plus applicable taxes, applies to each approved Service Request. The Processing Fee will be collected from you prior to fulfilling Your approved Service Request. Prepaid credit cards may not be used to pay Your applicable Processing Fee. We will cover the cost to repair or replace the Protected Device up to a maximum of $2,300.00, inclusive of a $500 per Service Request limit for Protected Accessories, per Service Request depending on the tier of Your Protected Device. Beginning on the Enrollment Date, this Device Protection Lite Plan Contract will cover up to, but not more than, two (2) repairs and/or replacements (if a replacement is provided to You) of the Protected Device during any twelve (12) month period, beginning on the date that the first approved Service Request is fulfilled. For Service Requests that are fulfilled with Replacement Equipment or the Protected Device has been mailed for repair, the fulfillment date is the date on which the Replacement Equipment or repaired Protected Device is shipped to You. For Service Requests that are fulfilled at an authorized repair location or repaired by an authorized repair technician, the fulfillment date is the date which the Repaired Protected Device is made available to You for collection. We will forward a notice of cancellation of the Contract to You, by mail, email or fax at the time of the second fulfilled Service Request, and We will discontinue all monthly charges for the Device Protection Lite Plan Contract at such time. The monthly charge paid for the Device Protection Lite Plan Contract during the month in which the second fulfilled Service Request occurs will be prorated up to the date of cancellation. The service limit does not apply to the repair or replacement of Protected Devices caused by defects in parts or workmanship during the standard product warranty.
Processing Fees. (a) Effective October 1, 2002, Customer shall pay FDMS the Processing Fees set forth in Exhibit B to this Agreement. Beginning on the date hereof and ending on September 30, 2002, Customer shall pay FDMS the prices set forth in the [****], respectively. Notwithstanding the two immediately preceding sentences, effective on the date hereof, Customer shall pay FDMS the Processing Fees set forth in Exhibit B to this Agreement for the line items designated with a pound sign (#). For each Processing Year after Processing Year 2, FDMS may increase the Processing Fees designated with an asterisk (*) in Exhibit B to this Agreement which were in effect for the immediately preceding Processing Year by an amount not to exceed [****] percent ([****]) of the percentage increase in the Consumer Price Index ("CPI"), during the period described below. For purposes of this paragraph, the CPI shall be the index compiled by the United States Department of Labor's Bureau of Labor Statistics, Consumer Price Index for All Urban Consumers ("CPI-U") having a base of 100 in 1982-1984. The percentage increase in the CPI shall be calculated and written notice given to Customer as of ninety (90) days in advance of the effective date of the Processing Fees increase, by comparing the CPI using a twelve (12) month period ending as of the date of calculation and expressing the increase in the CPI through the twelve (12) month period as a percentage. If the federal government changes its definition of or method of calculating the CPI-U or its applicable components during the Term of this Agreement, the parties will negotiate in good faith to determine the changes, if any, that should be made to this annual adjustment provision to reflect such CPI-U changes.
Processing Fees. Subject to Developer’s right to protest and/or pursue a challenge in law or equity to any new or increased Processing Fees, City may charge and Developer agrees to pay all Processing Fees which are in effect on a City-wide basis at the time permits, approvals, or entitlements are applied for.
Processing Fees. There is no fee to deposit checks using Mobile Deposit. You agree to immediately reimburse AFFCU for any negative balance in your account caused by your use of Mobile Deposit. In the event legal action is required, you agree to pay AFFCU for its reasonable attorney’s fees and court costs. If your use of Mobile Deposit causes a negative balance in your account, you also agree to pay AFFCU’s overdraft fees as disclosed in the Truth and Savings Fee Schedule. AFFCU will not be liable for negative balances on accounts caused by the non-payment of checks due to insufficient funds, mobile service or for any action by the member or authorized user of the account that results in the reversal of a deposit on the account. AFFCU reserves the right to discontinue Mobile Deposit or to suspend account access at any time due to a change in business conditions or the failure of any member to abide by the Online Banking Regulation E Disclosures and Terms of Agreement, the Mobile Deposit Agreement, or any other applicable AFFCU Agreements and Disclosures. You acknowledge that wireless providers may impose fees, limitations or restrictions. You agree that you are solely responsible for all such fees, limitations and restrictions. Mobile Deposit Availability Mobile deposit is generally available 24/7 through AFFCU’s mobile app. In the event that Mobile Deposit is temporarily unavailable due to system maintenance or technical difficulties, including those on the Internet service provider, cellular service provider or internet software; you may deposit your check at an ATM, branch location or via regular mail. AFFCU reserves the right to change, suspend, or revoke the Mobile Deposit service immediately and at any time without prior notice to you. Disclosure
