WIN will provide Customer with electrical power as set forth in the Agreement, as required for the Customer Equipment at each switch site; however, Customer shall be responsible for all costs associated with: (i) adding or modifying AC electrical units, (ii) termination of negative forty-eight (48) volt DC circuits, and (iii) installation of Customer apparatus needed to power the Customer Equipment, subject to WIN’s prior approval.
Such Customer Equipment shall be furnished by and maintained at the expense of Customer, except as otherwise provided.
If Customer modifies its Customer Information or Customer Equipment in a manner that necessitates a change to the Colocation Services, then Customer shall pay for the time and materials that WIN incurs to troubleshoot, modify, and make repairs necessary to adapt to Customer modifications.
Company will not be liable for any loss or damage resulting from any cause beyond Company's reasonable control, such as, but not limited to, fire, explosion, lightning, flood, earthquake, power surges or failures, strikes or labor disputes, floods, storms, tornadoes, acts of war, civil disturbances, acts of civil or military authorities or the public enemy, delays caused by Customer, Customer Equipment or Customer Service or equipment vendors or any other cause beyond Company's reasonable control.
Customer shall be limited to access and use of the Customer Area for the purpose of installing, operating, repairing, maintaining, replacing and removing Customer Equipment.
