Equipment Leased. The Equipment leased is described on each equipment invoice and installation notification subject to this Lease Supplement. The supporting equipment invoices, installation notifications and equipment serial numbers are summarized on Exhibit "A" attached hereto.
Equipment Leased a) The Equipment Subject to the terms and conditions set forth below, the Lessor leases to the State and agrees to maintain the following described equipment (the “Equipment”): The Equipment shall be new unless otherwise stated in this Agreement.
Equipment Leased. Lessor hereby leases to Lessee and Lessee leases from Lessor the equipment, along with the equipment attached thereto or contained therein as specified in Schedule A attached to this Lease and made a part hereof (the "Equipment"), together with all parts, components, accessories, replacements, substitutions, additions and improvements now or in the future attached to or forming a part thereof.
Equipment Leased. Lessor agrees to lease to Lessee and Lessee agrees to lease from Lessor each item of equipment described in each Schedule now or hereafter executed pursuant to this Lease, together with any attachments or accessories now or hereafter incorporated in or attached to said equipment (hereinafter "Equipment"). It is hereby agreed that additional Equipment may be leased hereunder by the execution of additional Schedules by Lessor and Lessee. Each such Schedule, when so executed, shall constitute a separate Lease of the Equipment described therein. Except as specifically modified in any Schedule, all of the terms and conditions of this Lease shall govern the rights and obligations of Lessee and Lessor with respect to the Equipment described in the Schedules. Whenever reference is made herein to "this Lease" or "the Lease" it shall be deemed to include all Schedules now or hereafter executed under this Lease.
Equipment Leased. 1.1 Lexington agrees to lease to Customer and Customer agrees to lease from Lexington the equipment listed on Schedule A attached hereto, now or from time to time hereafter executed by the parties and made part of this Agreement (hereinafter “Vehicle” or “Vehicles”). Customer’s execution of Schedule A shall constitute authorization for Lexington to acquire the Vehicles listed therein.
Equipment Leased. Lessee hereby leases from Lessor for use at or near Customer Name and Jobsite Address hereinafter called “jobsite,” all Equipment herein named and identified, which throughout this Agreement is designated in whole or in part as “Equipment”. Each article of Equipment shall remain in possession of Lessee and neither this Agreement nor any part thereof shall be assigned. Nor shall Lessee offer the Equipment rented hereunder to be used or possessed by any other person, firm or legal entity without the prior written consent of Lessor. Nor shall said Equipment be used in the performance of any work by Lessee other than that specified herein without Lessor’s prior written consent. Lessee further agrees not to remove any Equipment covered by this Agreement out of the United States economic zone, county, state, and jobsite specified above without the prior written consent of Lessor. Equipment Leased. Lessor hereby leases to Lessee, and Lessee hereby hires and takes from Lessor the following-described personal property (hereinafter, with all attachments, replacement parts, substitutions, additions, repairs and accessories incorporated therein and/or affixed thereto, and proceeds, referred to as "Equipment"): Describe Equipment fully, including make, kind of unit, model and serial numbers, and any other pertinent information.
Equipment Leased. Lessor hereby leases to Lessee, and Lessee agrees to hire from Lessor, an Xxxx-Xxxx .25 inch maximum Xxxxx Xxxx, Xxxxxx Xx. 00000-00 (hereinafter referred to as the `Equipment") for the term and consideration, and subject to the conditions and provisions hereinafter set forth.
Equipment Leased. This contract is a Master Equipment Lease and the terms of each Schedule of Machines ("Schedule") hereto are subject to any and all conditions and provisions set forth herein as may from time to time be amended. Each Schedule shall incorporate therein all of the terms and conditions of this Master Equipment Lease and shall contain such additional terms and conditions as XLDC and Customer shall agree upon. Each Schedule is enforceable according to the terms and conditions contained therein. In the event of a conflict between the language of this Master Equipment Lease and any Schedule hereto, the terms of the Schedule shall prevail with respect to that Schedule. This Master Equipment Lease and all Schedules hereto are collectively referred to as the "Agreement." XLDC agrees to lease to Customer, and Customer agrees to lease from XLDC, in accordance with the terms and conditions herein, the equipment and features, together with all replacements, parts, repairs, additions, attachments and accessories incorporated therein (collectively called the "Machines") described in each executed Schedule which shall be made a part hereof. Lessee shall have no right, title or interest in the Machines, except as expressly set forth in this Agreement. XLDC shall have no obligation hereunder until the execution and delivery of a Schedule by XLDC and Customer.
Equipment Leased. 1.1 In consideration of the rent to be paid by Xxxxxx and the covenants and agreements of Lessee hereinafter set forth, Lessor hereby agrees to lease from time to time to Lessee certain compressed air and boiler equipment (“Equipment”) as further described in the Rental. For each rental, Lessor shall issue a Quote setting forth the quantity and type of Equipment to be leased, the amount of rent to be charged for each item of Equipment, and the start/end date, among other pertinent details. Lessee shall issue a purchase order to Lessor referencing and incorporating said Quote, together referred to as “Rental”. Each Rental shall (a) by this reference, be incorporated into and made a part of this Agreement; and
