WITNESS TESTS. All "non-optional" factory testing described in Appendix L shall be successfully completed by Seller prior to Shipment of a Unit. Seller and Buyer shall mutually agree upon a specific list of factory tests ("Witness Tests") which Buyer's Inspectors shall witness, provided that such list may be supplemented at Buyer's request to permit Buyer to witness additional factory tests which Seller intends to conduct, upon reasonable advance notice to Seller. Such Witness Tests shall be initially identified as such in Appendix A.

WITNESS TESTS. TEST DATA APPROVAL – Witness tests specified by purchase order will normally be held at Hunterdon Transformer before the scheduled ship date. If the Buyer is not available to attend the Witness Test on the scheduled date the Buyer waives the right to Witness Test and authorizes the Seller to ship product. If Buyer approval of Test Data is required before shipment by purchase order or specification, Buyer agrees to complete test data review within one week or waives test data approval and authorizes shipment.

  • Random Testing Notwithstanding any provisions of the Collective Agreement or any special agreements appended thereto, section 4.6 of the Canadian Model will not be applied by agreement. If applied to a worker dispatched by the Union, it will be applied or deemed to be applied unilaterally by the Employer. The Union retains the right to grieve the legality of any imposition of random testing in accordance with the Grievance Procedure set out in this Collective Agreement.

  • ACCEPTANCE TESTS 11.1 If the Contract provides acceptance tests for Goods and/or the result of Services after their completion and/or delivery to the Purchaser, the acceptance shall only be considered as definitive when such tests have demonstrated the compliance of the Goods and/or the result of the Services to the requirements in the Contract.
