Use and Conduct. Resident may use and occupy the Premises for residential student housing purposes only. Resident may not conduct any commercial enterprise in the Premises. Resident shall cooperate and adjust to the concept and requirements of living in a student residence environment and shall not allow any disruptive behavior or conduct in the Premises or any nuisance in the Premises. Resident may not have any handgun; firearm; weapon of any type; explosive, flammable or hazardous substance; or anything else of a dangerous nature in the Premises. Resident may not allow the misuse of alcoholic beverages in violation of State law or University Hill Apartments rules and regulation, or the possession, use, sale or manufacture of illegal narcotics, marijuana, hypnotics, stimulants, hallucinogens or other similar known illegal drugs and/or chemicals in the Premises by Resident or Resident’s guests.

Tenant may not allow the misuse of alcoholic beverages in violation of State law or Xxxxx Student Living rules and regulations, or the possession, use, sale or manufacture of illegal narcotics, marijuana, hypnotics, stimulants, hallucinogens or other similar known harmful or habit-forming drugs and/or chemicals in the Premises or at Xxxxx Student Living by Tenant or Tenant’s guests.

Use and Conduct. During the Trademark Term, Apollo shall comply with CMU’s trademark guidelines (hppt://xxx.xxx.xxx/xxxxxxxx/xxxxxxxxx/Xxxxxxxxx.xxxx), as amended from time to time. During the Trademark Term, all documents and advertising and other materials on which the CMU Trademark appears shall be consistent with the standards promulgated from time to time by CMU. During the Trademark Term, Apollo shall provide one or more persons identified by CMU from time to time with samples of labels, promotional and advertising materials on which the CMU Trademark is utilized and CMU shall have the right to inspect Apollo’s goods and to monitor the use of CMU’s Trademarks in order to ascertain whether Apollo is in compliance with the obligations of use and quality control set forth herein. CMU’s expenses of such monitoring shall be borne by CMU. Apollo agrees that the CMU Trademark shall be used solely in such a manner so as to at all times constitute legal and authorized use of the same and Apollo will not do any act, or omit to do any act, except as expressly contemplated in this Agreement, that will in any way impair or affect CMU’s interest therein or the terms and intent of this Section 3.4.

Tenant may not allow the misuse of alcoholic beverages in violation of Applicable Law or the Community Rules and Regulations, or the possession, use, sale, or manufacture of illegal narcotics, marijuana, hypnotics, stimulants, hallucinogens, or other similar known harmful or habit-forming drugs and/or chemicals at the Property or at the Community by Tenant or Tenant's agents, guests, or invitees.WIth the exception of any substances as prescribed for Tenant and documented by a medical professional in accordance with Applicable Law. Tenant, and Tenant’s agents, guests or invitees may not smoke within the Premises or any indoor portion of the Community. In the event that, in the reasonable discretion of Landlord, Tenant shall engage in conduct that poses a risk of bodily harm, personal property or disruption to other tenants of the Community, their guests or invitees or to Landlord, its employees, guests or invitees, Landlord may declare Tenant in default hereunder, and Landlord may exercise its rights hereunder (including the right to evict the Tenant) without notice or cure, to the extent permitted by Applicable Law. Tenant must at all times act in such a manner as not to cause risk of bodily harm to Tenant. In the event that, in the discretion of Landlord, Tenant shall engage in conduct that poses a risk of bodily harm to Tenant, Tenant agrees that Landlord, its agents and employees, may take action as Landlord shall deem to be necessary in its sole discreti...
