Neither party shall use the name of the other party in publicity, advertising, or similar activity, without the prior written consent of the other, except that Licensee agrees that SAP and its affiliated companies may use Licensee's name in customer listings or, at times mutually agreeable to the parties, as part of SAP's marketing efforts (including without limitation reference calls and stories, press testimonials, site visits, SAPPHIRE participation). SAP will make reasonable efforts to avoid having the reference activities unreasonably interfere with Licensee's business. Licensee agrees that SAP may share information on Licensee with its affiliated companies for marketing and other business purposes and that Licensee has secured permission from its employees to allow SAP to share business contact information with its affiliates.

Prime Contractor shall not disclose the terms and conditions of this Agreement including the pricing contained in an Order Form to any third party including the Customer (save for any practical, non- commercial terms required by SAP to be passed through to the Customer by the Prime Contractor). SAP will make reasonable efforts to avoid having to reference activities that unreasonably interfere with Prime Contractor's business. Prime Contractor will take reasonable steps to procure similar rights for SAP in relation to the use of Customer’s name and Customer information if required. Prime Contractor agrees that SAP may share such information with its Affiliates for marketing and other business purposes and that it has secured appropriate authorizations to share Prime Contractor and Customer employee contact information with SAP as needed.

Insofar as this includes the provision and use of contact information of Licensee’s contact persons, Licensee will secure the appropriate permissions where necessary.

Neither party shall use the name of the other party in publicity, advertising, or similar activity, without the prior written consent of the other. However SAP may publish the information about Software Agreement successful signing, use Licensee's name in customer listings (reference listings) or to analyze details from the contract (e. g. to forecast demand), as well as – subject to mutual agreement – as part of SAP's other marketing efforts.
