Relationship to National Employment Standards. The entitlements in this Agreement are intended to be applied in satisfaction of, and not in addition to, any entitlements Employees may have under the National Employment Standards (“NES”). The Agreement is read and interpreted in conjunction with the NES. Where there is an inconsistency between this Agreement and the NES, and the NES provides a greater benefit, the NES provision will apply to the extent of the inconsistency.

Relationship to National Employment Standards. This Agreement shall be read and interpreted in conjunction with the National Employment Standards (NES) provided that where there is any inconsistency between this Agreement and the NES, the more beneficial provision to an employee shall take precedence.

Where this Agreement also has provisions regarding matters dealt with under the NES and the provisions in the NES set out in the Fair Work Act are more favourable to an Employee in a particular respect than those provisions, then the NES will prevail in that respect and the provisions dealing with that matter in this Agreement will have no effect in respect of that Employee. Where this agreement also has provisions regarding annual leave, personal leave/carer’s leave and/or parental leave and the provisions in the NES set out in the Act are more favourable to an employee in a particular respect than those provisions, then the NES will prevail in that respect and the provisions dealing with that matter in this agreement will have no effect in respect of that employee. The provisions in this agreement otherwise apply.
Relationship to National Employment Standards. Where the NES provides, or are varied to provide, a condition or entitlement more favourable to an employee in a particular respect than that set out in this Agreement, the condition or entitlement in the NES prevails.
