Employee Entitlements. The following Performance Review entitlements shall accrue to the employee:
(a) An employee shall have the right to a Performance Review at any time upon request;
(b) The employee shall have an opportunity to provide meaningful input into their performance appraisal. This includes the option of preparing a “self- appraisal” on the standard performance appraisal form, for submission to the Manager. Employees may also request that the Manager seek input from up to three (3) others (co-workers, suppliers, customers, Managers, etc.) with whom the employee had significant interaction during the review period and incorporate the information received into the appraisal. With respect to customers/suppliers, the Manager will, where appropriate and at the Manager’s discretion, make a reasonable effort to seek the above information;
(c) Section Heads should have input into the employee’s performance appraisals. Section Heads will normally be present at performance appraisal meetings, unless the employee requests otherwise;
(d) Overall assessments for employees and their distribution shall not be pre- determined. An employee’s performance appraisal cannot be finalized until after the performance appraisal process has been completed. For clarity: The appraisal process has not been completed until after the employee and Manager have met to discuss the performance appraisal.
(e) If requested by either the employee or the Manager, the performance review shall be conducted in two stages, as follows:
Employee Entitlements. Other than arising in the ordinary course of business before the Settlement Date, the Company is not under, nor will it assume before the Settlement Date, any liability for any pension, lump sum retiring allowance or redundancy payment or any liability with respect to holiday, long service or sick leave entitlement.
Employee Entitlements. The following Performance Review entitlements shall accrue to the employee:
Employee Entitlements. 22.1. Within three (3) months of approval of the Agreement, and in conjunction with the Union, the company will finalise the process, agreed as a general principle, to provide written assurances and individual details of accrued entitlements to each employee.
Employee Entitlements. Amount incurred but not paid at the end of the reporting period are accrued. Annual leave due, but not taken, is recognised as a liability.
Employee Entitlements. 32.01 (a) Casual employees shall be entitled to the following benefits:
Employee Entitlements. (a) The Employee Entitlement List accurately sets out the period of service, remuneration package, applicable allowances and accrued leave (including long service leave, annual leave and personal/carer’s leave) for each Employee as at the date of Completion.
(b) Except as disclosed in the Employee Entitlement List or otherwise arising in the ordinary course of business before the Completion Date, as at Completion no Target Entity is under any liability to any Employee for any pension, lump sum retiring allowance or redundancy payment or any liability with respect to annual, long service or personal leave.
(c) Except as disclosed in the Disclosure Materials, Employees are not entitled to participate in any share incentive scheme, share option scheme, bonus, commission or profit sharing scheme or other employee incentive scheme.
(d) Except as disclosed in the Disclosure Materials, Employees are not entitled to be paid by the Target Entities any amount, and are not entitled to any other benefit or special entitlement or right, upon a change of control of any of the Target Entities.
Employee Entitlements. The Contractor is responsible for:
(a) ensuring the adequacy of any workers’ compensation for its Staff; and
(b) payment of any sick pay, holiday pay, PAYG, fringe benefit tax, payroll tax, compulsory superannuation contributions and other statutory charges to or for Staff.
(c) The Contractor may not recover the cost of any employee entitlements from the Department
Employee Entitlements. It is acknowledged and agreed that the Purchase Price has been calculated taking into account the Employee Entitlements in respect of Transferring Key Persons and pre-Completion accrued remuneration and superannuation contributions of all employees of the Sale Companies and Transferring Key Persons and that no adjustment will be made to the Purchase Price in respect thereof.
Employee Entitlements. The parties to this Agreement agree to further discussions on employee entitlements during the life of this agreement, to genuinely examine other avenues regarding the securing of employee entitlements.
