PERSONNEL EMPLOYMENT. The CONSULTANT warrants that it has not employed or retained any company or person, other than a bona fide employee working solely for the CONSULTANT, to solicit or secure this agreement, and that he has not paid or agreed to pay any company or person, other than a bona fide employee working solely for the CONSULTANT, any fee, commission, percentage, brokerage fee, gifts, or any other considerations, contingent upon or resulting from the award of making of this Agreement. For breach or violation of this warranty, the OWNER shall have the right to annul this Agreement without liability or, in its discretion to deduct from the agreement price or consideration, or otherwise recover, the full amount of such fees, commission, percentage, brokerage fee, gift or contingent fee.
PERSONNEL EMPLOYMENT. A. 1. All new teachers will be placed on the proper step of the salary schedule according to their certification, experience, and education, but not to exceed Step 18 of the appropriate lane. No presently employed teacher will receive less than the salary indicated on the salary schedule for his/her credited certification, experience, and education.
PERSONNEL EMPLOYMENT. A. Employees returning to service shall be placed on the proper step and classification of the salary schedule according to their experience, education, and certification status. No employee shall receive less than the salary indicated on the salary schedule for the employee's credited experience and education if the employee has fulfilled continuing certification requirements, except that the salary paid to an educator returning to service will not exceed the salary of a CCPS educator with equal, continuous service.
PERSONNEL EMPLOYMENT. A. 1. With the exception of rehired retired teachers, all new teachers or reinstated teachers will be placed on the proper step of the salary schedule according to their certification status, experience, and education.
PERSONNEL EMPLOYMENT. 8.1.1. The Private Partner shall, at its own discretion and at its own expense, take all appropriate measures to ensure employment and remuneration of labor of the personnel in accordance with the Legislation.
PERSONNEL EMPLOYMENT. For the term of this Agreement and for twelve (12) months after termination, each party agrees that it shall not directly or indirectly, solicit, divert or hire away, or attempt to solicit, divert or hire away, any agent, or employee of the other party without prior written consent of the other party.
PERSONNEL EMPLOYMENT. On the basis of the schedule of staffing standards and wage rate projections set forth on Exhibit "B" attached hereto or, if different, those approved by the Owner in the Annual Budget, the Manager will hire, pay, supervise and discharge the personnel necessary to maintain and operate the Property. All such employees will be employees of the Manager and not the Owner, however, all salaries, wages and other compensation of personnel so employed by the Manager, including medical and health insurance, pension plans, social security, taxes, workmen's compensation insurance and similar salary and benefit expenses, will be expenses of the Common Areas of the Property and payable by the Owner. Notwithstanding the preceding, all salary and benefit expenses of executives or principal officers of the Manager who are not permanently assigned to the Common Areas of the Property on a full time basis will not be a cost of the Common Areas of the Property.

TRANSYSTEMS warrants that is has not employed or retained any company or person, other than a bona fide employee working solely for TRANSYSTEMS, to solicit or secure this Agreement, and that he has not aid or agreed to pay any company or person, other than a bona fide employee working solely for TRANSYSTEMS, any fee, commission, percentage, brokerage fee, gifts, or any other consideration, contingent upon or resulting from the award or making of this Agreement. For breach or violation of this warranty, the CLIENT shall have the right to annul this Agreement without liability, or, in it discretion, to deduct from the Agreement price or consideration, or otherwise recover, the full amount of such fee, commission, percentage, brokerage fee, gift or contingent fee.
PERSONNEL EMPLOYMENT. A. All Supervisors, tenured and non-tenured, must be notified of their contract and salary status for the ensuing year by May 15th.
