Personal/Carer’s Leave and Compassionate Leave. 10.1. Each Employee is entitled to personal/carer’s leave and compassionate leave in accordance with the provisions of the Act. Summary Division 5 of Part 7 of the Workplace Relations Act provides most employees with 10 days personal/carers leave per year and 2 days paid compassionate leave each time a member of their household such as a close family member dies or is dying. Personal/carer’s leave applies if an employee is sick or if they are caring for a sick member of their household. If the employee has exhausted his or her paid leave entitlement, the employee may take 2 days unpaid carers leave per occasion. Employees must provide medical certificates or statutory declarations to justify a claim for personal/carer’s leave if the Employer reasonably requests them to do so. Untaken Personal/carer’s leave accumulates from year to year, untaken compassionate leave does not. Part 7 of the Workplace Relations Act provides that casual employees are not entitled to minimum standards relating to paid carers leave. Instead, they receive a loading over and above their ordinary basic rate of pay. However, casual employees are entitled to two days unpaid carer’s leave on each occasion that a member of the employee’s immediate family or household requires care and support due to illness, injury, or an unexpected emergency
