Pay for Acting in a Senior Capacity. (a) Any employee covered by this Agreement who is required to accept the responsibilities and carry out the duties incident to a position or rank senior to that which the employee normally holds, for one (1) hour or more, shall be paid at the rate for the senior position or rank while so acting.
Pay for Acting in a Senior Capacity. 24.1 On every occasion that an employee is temporarily required, for a period of at least one (1) day to accept the responsibilities and carry out the duties of a position which is senior to the position s/he normally holds within the jurisdiction of this Collective Agreement, the employee shall be paid a differential of fifteen percent (15%) of their regular wages for every day that s/he carries out the duties of the senior position.

Appointments of employees to a level of higher responsibility must be authorized in writing by the Director or designate.

When an Employee is appointed to temporarily accept the responsibilities and to carry out substantially all of the duties incident to a position which is senior to the position which they normally hold, they shall be paid for every day the duties of the senior position are carried out at the minimum rate in the scale for such senior position which represents an increase over their normal rate. Appointments to act in the higher position must be authorized in writing by the Chief Constable or designate. If the acting appointment is known to be three (3) consecutive months or longer from the outset, any paid leave taken during the period will be paid at the higher rate. If the acting appointment becomes three (3) consecutive months or longer, paid leave from the three (3) months point onwards will be paid at the higher rate. This provision only applies to 5.04 Pay for Acting in a Senior Capacity, and does not include paid leave taken from an overtime bank.

(a) On every occasion that an inside employee is temporarily required by the manager or appointed delegate to temporarily accept the responsibilities and carry out the duties of a position covered by this Agreement which is senior to the position which the employee normally holds, that employee shall be paid at the minimum rate in the scale for such senior position for either one-half or the full day (as authorized by Department Manager or delegate) rate of pay for the higher rated class for the time spent performing such duties. Where the salary received in the employee’s own position is equal to, or exceeds, the minimum of the senior position in which the employee is acting, the employee shall receive the next higher rate in the pay range of the senior position.

Where the salary received in the employee’s own position is equal to, or exceeds, the minimum of the senior position in which the employee is acting, the employee shall be advanced to the senior position’s step that provides a minimum of four percent (4%) higher rate of pay relative to the employee’s own position.
