Paid Compassionate leave entitlement. An employee is entitled to a period of 2 days paid compassionate leave for each occasion when a member of the employee’s immediate family or household: • contracts or develops a personal illness that poses a serious threat to his or her life; or • sustains a personal injury that poses a serious threat to his or her life; or • dies. Evidence that is reasonably required of the illness, injury or death must be given by the employee to the employer if so requested. Compassionate leave is able to be taken as follows: • a single unbroken period of 2 days; or • 2 separate periods of 1 day each; or • any separate periods to which the employee and his or her employer agree. An employee is entitled to take compassionate leave at any time while the illness or injury persists. The employer must pay the employee the amount the employee would have reasonably have expected to be paid by the employer if the employee had worked during that period.
Paid Compassionate leave entitlement. An Employee may take 22.5 hours (three days) of compassionate leave on Full Pay for each occasion when the Employee’s immediate family or member of household: contracts or develops a personal illness or sustains an injury that poses a serious threat to their life; or dies.
Paid Compassionate leave entitlement. An employee is entitled to a period of two days compassionate leave for each occasion when a member of the employee’s immediate family or household: • contract or develops a personal illness that poses a serious threat to his or her life; or • sustains a personal injury that poses a serious threat to his or her life; or • dies, or • a child is miscarried or stillborn, where the child would have been a member of the employee’s immediate family, or a member of the employee’s household, if the child had been born alive. Evidence that is reasonably required of the illness, injury, death, miscarriage or stillbirth must be given by the employee to the employer if so requested. Compassionate leave is able to be taken as follows: • a single unbroken period of two days; or • two separate periods of one day each; or • any separate periods to which the employee and his or her employer agree. An employee is entitled to take compassionate leave at any time while the illness or injury persists. The employee is entitled to payment for a period of compassionate leave in accordance with the Act.

A defacto spouse in relation to an employee, means a person who has (or formerly did so) lived in a bona fide domestic relationship with the employee, although not legally married to that person; and (b) child or an adult child (including an adopted child, a stepchild, or an ex nuptial child) parent, grandparent, grandchild, or sibling of the employee or spouse of the employee; (c) Aboriginal definitions of family which are identified and accepted by ▇▇▇▇▇▇▇▇▇▇▇ ▇▇▇▇▇ of SA. (b) Clause 7.3.1(a)(iii) does not apply to a former spouse or former de facto partner. (c) Evidence that is reasonably required of the illness, injury or death must be given by the employee to the employer if so requested. (d) Compassionate leave is able to be taken as follows: (i) a single unbroken period of two days, or (ii) two separate periods of 1 day each, or (iii) any separate periods to which the employee and the employer agree. (e) An employee is entitled to take compassionate leave at any time while the illness or injury persists. (f) Compassionate leave is paid at the employee’s base rate of pay for their ordinary hours of work during the period of leave.
Paid Compassionate leave entitlement i. An employee is entitled to a period of up to three (3) days paid compassionate leave for each occasion when: • a member of their immediate family or household dies, or contracts or develops a life-threatening illness or injury • a baby in their immediate family or household is stillborn • they have a miscarriage • their current spouse or de facto partner has a miscarriage. ii. Evidence that is reasonably required of the stillbirth, miscarriage, illness, injury or death must be given by the employee to the employer if so requested. iii. Compassionate leave is able to be taken as follows: • a single unbroken period of up to 3 days, or two or three separate periods; or • any separate periods to which the employee and his or her employer agree. iv. An employee is entitled to take compassionate leave at any time while the illness, injury or circumstances persists. v. The employer must pay the employee the amount the employee the ordinary base rate of pay in respect of leave taken during that period. vi. Further leave may be granted, on a discretionary basis, subject to the specific circumstances.
Paid Compassionate leave entitlement. A Staff Member may take 22.5 hours (3 days) of compassionate leave on Full Pay for each occasion when the Staff Member’s Immediate Family or Member of Household: contracts or develops a personal illness or sustains an injury that poses a serious threat to their life; and/or dies. A Staff Member may take compassionate leave for a particular occasion as prescribed in clause 40.1.1 as a single continuous period or as separate periods totalling 22.5 hours, as agreed between the Staff Member and their Line Manager. If a Staff Member has fully utilised their compassionate leave entitlement as prescribed in clause 40.1.1, they may be entitled to access Personal Leave as prescribed in clause 39, Personal and Carer’s Leave. This clause does not apply to Casual Staff Members.
