No Further Benefits. Except as otherwise set forth in this Section 6, following any termination of Employee’s employment, notwithstanding any provision to the contrary in this Agreement, the obligations of OMNI to pay or provide Employee with compensation and benefits under Section 4 and 5 hereof shall cease, and OMNI shall have no further obligations to provide compensation or benefits to Employee hereunder. Employee expressly acknowledges that any severance payments under this Section 6 are in lieu of any other payments or benefits that Employee may otherwise be eligible to receive under any Company plan, policy or program providing for severance, separation pay or salary continuation payments or benefits.
No Further Benefits. Employee acknowledges that the amounts payable and the benefits provided pursuant to this Section 6 are the exclusive items in the nature of salary, bonus, benefits and perquisites to which Employee is entitled in connection with the termination of his employment during the Employment Period or due to non-renewal by Employee or Company of this Agreement in accordance with Section 1 above.
No Further Benefits. Except with respect to Unreleased Claims, Employee hereby acknowledges and agrees that the severance payment provided pursuant to this Section 2 is in full discharge of any and all liabilities and obligations of the FedEx Group to her, monetarily or with respect to employee benefits or otherwise, including but not limited to any and all obligations arising under any written or oral agreement, policy, plan, or procedure of the FedEx Group or any understanding or arrangement between Employee and the FedEx Group.
No Further Benefits. Except as provided in this Agreement or as required by the terms of a Company sponsored employee benefit plan in which Executive is participating on the Termination Date, no payment, compensation, leave time, insurance or other benefits will be furnished or paid to Executive. Executive understands the Company may change payroll dates, schedules or amounts payable on such payroll dates, insurance carriers or employee benefit plans or otherwise modify its payroll or employee benefit plans for its active employees and, to the extent Executive is receiving salary continuation payments on payroll dates or is entitled to any such coverage or benefit after the Termination Date, those changes will be applied to Executive as well and in a manner consistent with applicable law. Except as specifically provided for in this Agreement or the terms of the applicable employee benefit plan, as of the Termination Date, Executive will cease to be eligible to participate under, or be covered by, any compensation or employee benefit plan and has no rights under any of those plans.
No Further Benefits. In the event the Executive is entitled to receive any Severance Benefits or any CIC Severance Benefits under this Agreement, he shall not be entitled to any payment or benefit under any other severance plan, program, agreement or similar arrangement of the Company or any of its affiliates.
No Further Benefits. After the Separation Date, Executive shall cease to be eligible for any benefits under any Company employee benefits plan or program or otherwise, except (i) as expressly provided in this Agreement, or (ii) as otherwise required under the terms of a Company employee benefits plan or program or applicable law. Notwithstanding the foregoing, nothing contained herein shall be construed to adversely affect Executive’s rights and benefits under the Company’s 401(k) plan and under stock options awards, which rights shall continue, after the Separation Date, to be governed by the terms of the plan and the awards, and as such plan and awards treat the termination of employment.
No Further Benefits. (a) The Native Title Party agrees that the State will not provide any further Benefits under the Principal Acts other than the Benefits set out in this Agreement and the Foundation Proponent will not provide any further Benefits other than the Benefits set out under this Agreement.
No Further Benefits. I understand and agree that the consideration provided to me under the terms of this Agreement is in addition to anything of value to which I am otherwise entitled. I represent, warrant and acknowledge that the Company owes me no wages, compensation, or payments or form of remuneration of any kind or nature, including any salary, bonus or incentive compensation, other than as specifically provided for in this Agreement or in a subsequent written agreement between me and the Company, or as otherwise vested under the terms of any Company benefit plan.
No Further Benefits. Except as otherwise provided in this Agreement, Executive acknowledges that the amounts payable and the benefits provided pursuant to Section 4 hereof are the exclusive items in the nature of salary, bonus, benefits, and perquisites to which Executive is entitled in connection with the termination of his employment for any reason.
No Further Benefits. The Employee hereby acknowledges and agrees that, as of the Termination Date, the payments and benefits described in this Section 2, and the other provisions of this Agreement including those set forth in Sections 3(c), 3(f), and 8, will be in full discharge of any and all liabilities and obligations of the Company Group to him, monetarily or with respect to employee benefits or otherwise, including but not limited to any and all obligations arising under any written or oral employment agreement, policy, plan, or procedure of the Company Group or any understanding or arrangement between the Employee and the Company Group.
