Nature of Appointment. This will be a statement as to whether the position is full-time, part-time, a locum or some other form of fixed term appointment. It should also record the total “size” of the job. Weekly or Fortnightly Timetable: At the time of appointment, each employee is entitled to a schedule of fixed or routine duties, including a weekly timetable. It will also record the free days or half-days in each week.
Nature of Appointment. The Agent shall have no fiduciary relationship with any Bank by reason of this Agreement and the Loan Documents. Nature of Appointment. The parties mutually agree to terminate the Employment Agreement dated April 14, 2014 by and between the parties. Effective with the termination of that Employment Agreement, and the retirement of Xxxxxx X. Xxxxxxxx from the Ohio Police and Fire Pension Fund, this Agreement shall take effect, and Xxxxxxxx shall be immediately appointed the City Manager of the City of Xxxxx Heights. As such, Xxxxxxxx shall perform the functions and duties specified in the Charter and City Code, and to perform such other legally permissible and proper duties and functions as the City Council shall from time to time assign, subject to this Agreement. As a result of the duties of City Manager Xxxxxxxx is expected to respond to certain emergencies, and conduct activities associated with all city services; therefore, City will provide a City owned vehicle for his use. Xxxxxxxx agrees that he will support the Constitution of the United States, the Constitution of the State of Ohio, the Charter and all Ordinances of the City of Xxxxx Heights, Ohio, and will at all times faithfully, honestly, and impartially discharge the duties of the office of the City Manager to the best of his abilities.
Nature of Appointment. (a) Novogen's engagement to provide the Services is as an independent contractor. Nothing in this document is to be treated as creating a partnership or joint venture between the parties under the laws of any applicable jurisdiction.

Nature of Appointment. The appointment is exclusive within the Territory, and NetWolves shall not appoint any other distributors within the Territory as long as this Agreement is in full force and effect. In furtherance of this appointment, NetWolves will clearly identify Anicom as its exclusive distributor in the Territory on NetWolves' website. Notwithstanding the foregoing, NetWolves shall have the right to make direct sales or leases of the Products to customers, Distributors and Anicom Resellers, and NetWolves agrees to pay Anicom a * commission on any sales or leases made by NetWolves that Anicom is not involved with in the Territory, and to pay Anicom a * commission on NETS (NetWolves Enhanced Technical Support) revenues within the Territory, provided that any such sales or leases to Distributors shall be counted as orders from Anicom for purposes of Sections 5.3 and 8.2, but otherwise, sales or leases of Products by NetWolves to other parties, including without limitation, the * pursuant to an agreement entered into prior to this Agreement, will not be counted as orders from Anicom for purposes of Section 5.3 and 8.2. Payment of any commissions to Anicom will be made by NetWolves within forty-five (45) days of the receipt of funds from such customers. Should NetWolves fail to pay any commissions when due, Anicom will charge interest on the outstanding commissions at the lower of 1-1/2% compounded monthly or the maximum rate permitted by law.
Nature of Appointment. MCI WorldCom understands that, subject to Section 2.3, this appointment is non-exclusive and that Metricom will establish other means of distribution, appoint other distributors and resellers, and/or use its own direct sales personnel to identify, register and support Subscribers and to promote the Service. Similarly, Metricom understands that MCI WorldCom may market, sell and distribute services similar or identical to the Service, whether provided directly by MCI WorldCom or a third party.
