Mortgagee Not Obligated to Construct Sample Clauses

Mortgagee Not Obligated to Construct. Notwithstanding any of the provisions of this Agreement, including, but not limited to, those which are or are intended to be covenants running with the land, a Mortgagee, including any Mortgagee who obtains title to the Project Site or any part thereof as a result of foreclosure proceedings, or conveyance or other action in lieu thereof, or other remedial action, shall in no way be obligated by the provisions of this Agreement to construct or complete the Project or any part thereof or to guarantee such construction or completion. The foregoing provisions shall not be applicable to any party who, after a foreclosure, conveyance or other action in lieu thereof, or other remedial action, obtains title to some or all of the Project Site from or through the Mortgagee, or any other purchaser at a foreclosure sale other than the Mortgagee itself, on which certain Community Benefits must be completed as set forth in Section 4.2. Nothing in this Section or any other Section or provision of this Agreement shall be deemed or construed to permit or authorize any Mortgagee or any other person or entity to devote the Project Site or any part thereof to any uses other than uses consistent with this Agreement and the Approvals, and nothing in this Section shall be deemed to give any Mortgagee or any other person or entity the right to construct any improvements under this Agreement (other than as needed to conserve or protect improvements or construction already made) unless or until such person or entity assumes Developer’s obligations under this Agreement.

Mortgagee Not Obligated to Construct. Notwithstanding any of the provisions of this Agreement, including but not limited to those which are or are intended to be covenants running with the land, a Mortgagee shall in no way be obligated by the provisions of this Agreement to construct or complete the Private Improvements thereon or to guarantee such construction or completion or to perform any of the Developer's other agreements, obligations or covenants under this Agreement with respect to the Building Site (other than those limiting the uses permitted to be developed on the Building Site, and other requirements of this Agreement applicable to any improvements which the Mortgagee undertakes to construct on the Building Site), nor shall any covenant or any other provision in the Deed with respect to the Building Site be construed to so obligate such Mortgagee; it is further provided that nothing in this Section or any other Section or provision of this Agreement shall be deemed or construed to permit or authorize any such holder to devote the Building Site or any part thereof to any uses, or to construct any improvements thereon, other than those uses or Private Improvements provided or permitted in this Agreement.
Mortgagee Not Obligated to Construct. Notwithstanding any other provision of this Agreement, including those that are or are intended to be covenants running with the land, a Mortgagee, including any Person who obtains title to all or any portion of or any interest in the Project, the Property or any Portion as a result of foreclosure proceedings, or conveyance or other action in lieu thereof, or other remedial action, including (a) any other Person who obtains title to the Property or any Portion from or through such Mortgagee or (b) any other purchaser at foreclosure sale, shall in no way be obligated by the provisions of this Agreement to Commence Construction or Complete Construction. Nothing in this Section 13.3 or any other provision of this Agreement shall be deemed or construed to permit or authorize any Mortgagee or any other Person to devote all or any portion of the Property to any uses, or to construct any improvements, other than uses and improvements consistent with this Agreement and the other Redevelopment Requirements.
Mortgagee Not Obligated to Construct. Notwithstanding any other provision of this DDA, including those that are or are intended to be covenants running with the land, a Mortgagee, including any Person who obtains title to all or any portion of or any interest in the Project Site as a result of foreclosure proceedings, or conveyance or other action in lieu thereof, or other remedial action, including (a) any other Person who obtains title to real property in the Project Site or such portion from or through such Mortgagee or (b) any other purchaser at foreclosure sale, shall in no way be obligated by the provisions of this DDA to Commence or Complete Infrastructure or Vertical Improvements or to provide any form of Adequate Security for such Commencement or Completion. Nothing in this Section 20.3 or any other Section or provision of this DDA shall be deemed or construed to permit or authorize any Mortgagee or any other Person to devote all or any portion of the Project Site to any uses, or to construct any improvements, other than uses or Improvements consistent with the Redevelopment Requirements.
Mortgagee Not Obligated to Construct. Notwithstanding anything in this Agreement to the contrary, a Recognized Mortgagee shall not be obligated to construct or complete any portion of the Project covered by the Recognized Mortgage or to guarantee the completion of the same; provided, however, that nothing herein contained shall be deemed or construed to permit or authorize the Recognized Mortgagee or any Foreclosure Transferee to devote the Disposition Parcels or any part thereof to any uses, or to construct any improvements thereon, other than those uses or improvements provided or permitted by this Agreement.
Mortgagee Not Obligated to Construct. Notwithstanding any of the provisions of this Agreement, a Mortgagee or its designee for purposes of acquiring title at foreclosure shall in no way be obligated by the provisions of this Agreement to construct or complete the Improvements or any portion thereof or to guarantee such construction or completion; provided, however, that nothing in this Agreement shall be deemed or construed to permit or authorize any such Mortgagee, or any owner of the Development whose title thereto is acquired by foreclosure, trustee sale or otherwise, to devote that Development to any uses, or to construct any improvements thereon, other than the Improvements contemplated in this Agreement.

Mortgagee Not Obligated to Construct. Notwithstanding any of the provisions of the Agreement, including but not limited to those which are or are not intended to be covenants running with the land, the holder of any mortgage authorized by the Agreement (including any such holder who obtains title to the Cricket Lot or any part thereof as a result of foreclosure proceedings, or action in lieu thereof, but not including (a) any other party who thereafter obtains title to the Cricket Lot or such part from or through such holder, or (b) any other purchaser at foreclosure sale other than the holder of the mortgage itself) shall in no way be obligated by the provisions of the Agreement to construct or complete the Project or to guarantee such construction or completion; nor shall any covenant or any other provision in the Deed be construed to so obligate such holder; provided that nothing in this Section or any other Section or provision of the Agreement shall be deemed or construed to permit or authorize any such holder to devote the Cricket Lot or any part thereof to any uses, or to construct any Project therein, other than those uses and the Project provided or permitted in the Agreement.
Mortgagee Not Obligated to Construct. No Mortgagee, including any Mortgagee who obtains title to any portion of the Property, or any part thereof, as a result of foreclosure proceedings or action in lieu thereof, shall be contractually obligated by the provisions of this Agreement to construct or complete the construction of any Improvements or to guarantee such construction or completion; nor shall any covenant or any other provisions of this Agreement be construed so as to obligate such Mortgagee.
