Modification of Charges. The facility shall reserve the right to change the fee and rate schedule. Usually an advance notice is in the agreement. Basic Components of the Resident Service Agreement
Modification of Charges. WilTel reserves the right to eliminate Service offerings and/or modify charges for Service offerings (which charge modifications shall not exceed then-current generally available WilTel charges for comparable services), upon not less than sixty (60) days prior notice to Customer, which notice will state the effective date for the charge modification. In the event WilTel notifies Customer of an increase in the charges, Customer may terminate this Agreement, without incurring a cancellation charge only with respect to the Service offering affected by the increase in charges. In order to cancel that offering, Customer must notify WilTel, in writing, at least thirty (30) days prior to the effective date of the increase in charges. Further, in the event Customer cancels its subscription to a Switched Service offering as described in this Subsection 5(D), WilTel and Customer agree to negotiate in good faith concerning Customer’s Minimum Monthly Commitment, if any, described in the PET.
Modification of Charges the parties agree to delete Subsection 5(D) of the Agreement in its entirety and replace it with the following provision:
Modification of Charges. The Facility reserves the right to change from time-to-time the Rate Schedule reflecting the amount of any of its charges or how and when its charges are computed, billed or become due. The Facility shall provide sixty (60) days advance written notice of any such changes in the Rate Schedule.
Modification of Charges. WilTel reserves the right to eliminate Service offerings, modify charges and/or add charges for Service offerings (which charge modifications shall not exceed then-current generally available WilTel charges for comparable services), upon not less than sixty (60) days prior notice to Customer, which notice will state the effective date for the charge modification or service modification. In the event WilTel notifies Customer of the elimination of a Service offering and/or an increase in the charges, Customer may terminate this Agreement, without incurring a cancellation charge only with respect to the Service offering affected by the increase in charges. In order to cancel that offering, Customer must notify WilTel, in writing, at least fifteen (15) days prior to the effective date of the increase in charges. Further, in the event Customer cancels its subscription to a Switched Service offering as described in this Subsection 5(D), WilTel and Customer agree to negotiate in good faith concerning the decrease of Customer's Minimum Monthly Commitment, if any, described in the PET.
Modification of Charges. In consideration of good and valuable consideration, including without limitation, the Special International Rates described above, the receipt and sufficiency of which are hereby acknowledged, notwithstanding anything to the contrary contained in the Agreement, MCI reserves the right to modify all of Customer’s rates to International locations (including the Special International Rates described in Section 1 above) upon not less than seven (7) calendar days’ prior notice to Customer, which notice will state the effective date for the charge modification and may be sent by e-mail or facsimile. Provided, however, any charge modifications under this Section 2 shall not exceed then-current generally available MCI charges for comparable services.
Modification of Charges. The parties hereby modify Article 5 of the Agreement by deleting it in its entirety and replacing it with the following language:
Modification of Charges reserves the unilateral right to change, add or delete Service offerings and/or modify charges for Service offerings including those rates listed in all attached Exhibits, upon three (3) days notice to CUSTOMER. However, in the event the CUSTOMER is in default, or breach of this Agreement, may unilaterally and immediately upon written notice to the CUSTOMER modify or amend the rates and or service on an immediate, zero (0) day written notice to the CUSTOMER.
Modification of Charges. Charges may be increased based on the WISE Raw Water Rate and/or on an update to the cost of service model, incorporating capital and operational costs following the utility basis for ratemaking prescribed in Attachment C. Aurora shall provide notice to the Authority of any proposed rate adjustment prior to October 1, and the Authority shall have the opportunity to comment on the proposal prior to the effective date of the rate on January 1 of the following year.
Modification of Charges. Each Party reserves the unilateral right to -------------------------- change, add or delete Service offerings and/or modify charges for Service offerings including those rates listed in all attached Exhibits, upon five (5) days notice to the other Party. However, in the event either Party is in default, or breach of this Agreement, the other Party may unilaterally and immediately upon written notice to the other Party modify or amend the rates and or service on an immediate, zero (0) day written notice to the other Party.
