Legal Leave. 19.12.1The University shall grant leave of absence with pay to a member of faculty who is called to serve as a juror or a witness in a court of law in a matter in which he/she is not a party or an accused.

Legal Leave. The Board shall grant leave of absence with pay to a faculty member who is called to serve as a juror, a witness, or, in the case of an action resulting from the performance of their contractual obligations to the University, as either a plaintiff or defendant, in a court of law. Any reimbursement for such duty, less out of pocket expenses, shall be remitted forthwith to the University cashier.
Legal Leave. The school employer will only grant legal leave to a teacher subpoenaed to serve jury duty, testify in court as a witness in a case in which the teacher is not a party to the suit, or testify in court in any suit arising out of the performance of the duties for, or employment with, the school corporation. The leave shall be for the number of days mandated to perform such obligation. Compensation for such legal leave shall be calculated as the difference between the teacher’s contracted daily rate and the pay received for such mandated duty.

Legal Leave. In the event it is necessary for a teacher to make appearance(s) in any judicial proceeding resulting from activities relating to the teacher’s employment with the school corporation, and during his or her regular assigned duty time, the teacher shall receive full compensation without loss of accumulated leave days. However, this section shall not apply in the event the teacher is a plaintiff or in such proceedings to enforce IC 20-29.

Legal Leave. 1. Teachers will be granted leave without loss of pay to perform required jury duty. All compensation received by the teacher for performing required jury duty must be given to the district, except mileage reimbursement, to be granted paid leave.
Legal Leave. When a teacher is served a subpoena to appear in court of for a deposition as a result of his/her legal, school obligation or duty, the Board shall pay the teacher his/her full salary. Should the teacher receive any compensation for appearing in court or at a deposition, the teacher shall return the entire amount to the Board.
Legal Leave. If suit is brought against a teacher for action taken within Board Policy and the scope of his/her employment, the teacher shall be entitled to leave with pay for any periods of work which are missed while participating in such proceedings. If a teacher misses work because of jury duty, or if a teacher is required by subpoena to give testimony before a judicial tribunal in a proceeding in which the teacher is not a party (i.e. plaintiff, defendant, etc.) the teacher shall be paid his/her normal compensation for any periods of work so missed less the amount that the teacher receives for such duty. No teacher is entitled to leave with pay under this section in a situation where the teacher is involved in personal litigation.
