Landscaping Standards. The Developed area of the Property shall include significant street, landscape and natural plantings and landscaped areas and tree protection measures. Native plant species will be selected for a majority of the street trees. A portion of the tree and landscape areas may also have a stormwater management function at the Property. A street tree planting plan that provides for shading of all sidewalk and street pavement areas shall be incorporated into the Property. Due to the preservation of Xxxxxx Creek Preserve (see Section 5.12), no tree canopy requirements are applicable. The applicant shall include the following information in each Development Agreement Compliance Permit application: A plan of street landscaping and landscaped areas and associated irrigation; A planting list using mostly the suggested native trees from the Town’s Design Manual for canopy trees or other approved species; Details for proposed tree pits and grates; Identification of conflicts between street trees and utilities. A tree maintenance program will be provided with the first Development Agreement Compliance Permit application. A maintenance program of best forestry management practices within the Preserve will be submitted for approval by the Town Manager. See Exhibit B for landscape standards for specific site areas. Sediment and Erosion Control. Development design and construction shall comply with applicable state and local soil and erosion control regulations and shall incorporate erosion and sediment control measures for all land-disturbing activities. The Developer Owners, Parcel Owners or the Representative shall be responsible for implementing erosion and sedimentation control measures for all land disturbing projects. RECOMMENDED TREES FROM THE XXXXX COUNTY DEVELOPMENT STANDARDS SHOULD BE TAKEN INTO ACCOUNT WHEN CHOOSING SPECIES. AREAS TO BE LANDSCAPED BY THE DEVELOPER INCLUDE THE DRYLAND GROOMED LANDSCAPE BUFFER ALONG XXXXXXX ROAD AND 26TH AVENUE, THE NEIGHBORHOOD PARK AND OTHER AREAS. THE HOMEBUILDER IS RESPONSIBLE FOR THE LANDSCAPING IN THE FRONT YARDS OF THE HOMES BETWEEN THE BACK OF CURB AND THE FRONT OF THE HOUSE. HOMEOWNERS WILL BE RESPONSIBLE FOR BACKYARD LANDSCAPING IN ACCORDANCE WITH XXXXX COUNTY CODE AND LANDSCAPING DESIGN REQUIREMENTS AND PERFORMANCE STANDARDS.   • Operating Standards The Operating Standards attached to this Agreement as Exhibit "B" are hereby made an integral part of this Agreement. Lessee, its employees, agents, guests, invitees, visitors and/or any other persons caused to be present in and around the Premises by the Lessee shall perform and abide by the rules and regulations and any amendments or additions to said rules and regulations as Lessor may make. In addition, Lessee, its employees and agents shall abide by all applicable governmental rules, regulations, statutes and ordinances relating in any way to the Premises or the Facility or Lessee's use or occupancy of the Premises or the Facility; failing which Lessee shall be in default hereunder and shall pay any fines or penalties imposed for such violation(s) directly to the appropriate governmental authority or to Lessor, if Lessor has paid such amount on behalf of Lessee. Such remedy shall not be exclusive. It is hereby further explicitly agreed and understood that full compliance with the Operating Standards as set forth constitutes a material obligation of this Agreement, and that the failure to so comply shall constitute a violation of this Agreement entitling the Lessor to exercise any of its remedies pursuant to this Agreement or otherwise.

  • Licensing Standards The Contractor, its employees and subcontractors shall comply with all applicable licensing standards, certification standards, accrediting standards and any other laws, rules, or regulations governing services to be provided by the Contractor pursuant to this Contract. The State will not pay the Contractor for any services performed when the Contractor, its employees or subcontractors are not in compliance with such applicable standards, laws, rules, or regulations. If any license, certification or accreditation expires or is revoked, or any disciplinary action is taken against an applicable license, certification, or accreditation, the Contractor shall notify the State immediately and the State, at its option, may immediately terminate this Contract.

  • Manufacturing Standards All forest products except poles, produced and sold under this contract will be manufactured to maximize the amount of logs meeting preferred log lengths and to achieve the average log length listed. Agreement No. Sort # Scaling Rule 97318 3 WS Average Log Length Preferred Log Lengths "WS" indicates that west side scaling rules apply. Minimum trim is 8 inches per scaling segment for west side scaling rules. "ES" indicates that east side scaling rules apply. Minimum trim is 4 inches per scaling segment for east side scaling rules. Poles produced under this contract will be manufactured to ANSI specifications (American National Standard Specifications and Dimensions for Wood Poles), in force at the time of signing this contract.

  • Landscaping Maintaining, tending and cultivating and (as necessary) re-stocking any garden or grassed areas including replacing plants, shrubs and trees as necessary.

  • OMB Standards Unless specified otherwise within this agreement, the Subrecipient shall procure all materials, property, or services in accordance with the requirements of 24 CFR 84.40−48.

  • Common Areas - Rules and Regulations Lessor or such other person(s) as Lessor may appoint shall have the exclusive control and management of the Common Areas and shall have the right, from time to time, to establish, modify, amend and enforce reasonable Rules and Regulations with respect thereto in accordance with Paragraph 40. Lessee agrees to abide by and conform to all such Rules and Regulations, and to cause its employees, suppliers, shippers, customers, contractors and invitees to so abide and conform. Lessor shall not be responsible to Lessee for the non-compliance with said rules and regulations by other lessees of the Industrial Center.

  • Work Standards The Contractor shall execute its responsibilities by following and applying at all times the highest professional and technical guidelines and standards. If the State becomes dissatisfied with the work product of or the working relationship with those individuals assigned to work on this Contract, the State may request in writing the replacement of any or all such individuals, and the Contractor shall grant such request.

  • Design Standards Most recent edition of the “Owner’s Design Standards,” including any partial updates as may be directed by the Owner.
