If the Project required a Developer Grading Permit, then the City shall accept the security posted under Section 1 hereof as adequate security under the City Code to authorize the issuance of that Developer Grading Permit.
Such temporary easements/agreements shall be obtained and copies provided to the City prior to the issuance of the Developer Grading Permit for the Project, as applicable.
If the Project required a Developer Grading Permit, then the Developer shall post security for the Project, in a form acceptable to the City, in an amount equal to the flat fee of Two Hundred Dollars ($200.00 plus Ten Cents ($0.10) per square foot of area disturbed, as shown on the City-approved grading permit plans and cost estimate (collectively, the “Plans”).
