Implementation of Restoration. The PARK agrees to, and shall be solely responsible for implementing, the program in accordance with the general procedures and methods contained in the document entitled, Restoration of Former Wetlands within the Hole-in-the-Donut in Everglades National Park; Project Plan and Specifications, attached hereto as Exhibit B. The PARK shall be solely responsible for obtaining all of the required federal, state and local permits for the performance of the work, writing and awarding of contracts or cooperative AGREEMENTs regarding implementation of work, scheduling, hiring and payment of personnel, purchase or rental of supplies, materials and equipment or other project support as necessary. The PARK may, at its sole discretion, add to or modify the methods or procedures contained in Exhibit B as deemed necessary or appropriate based on information from the results of previous or ongoing project work, monitoring data or study results in order to improve or enhance any of the elements or purposes of this project as described in this AGREEMENT, provided, however, that such modification shall not alter the PARK'S obligation to mitigate the number of acres for which payments have been committed prior to such modification pursuant to this AGREEMENT. This AGREEMENT, including all appendices, attachments and codicils shall not under any of its terms, limitations or conditions be considered by any of the parties to this AGREEMENT to encumber or otherwise in any way limit the use or direction of funds received from sources other than those described within this AGREEMENT by the FOUNDATION on behalf of the PARK.
