The Hole. In the event the hole should be lost or damaged, Operator shall be solely responsible for such damage to or loss of the hole, including the casing therein. Operator shall release Contractor and its suppliers, contractors and subcontractors of any tier of any liability for damage to or loss of the hole, and shall protect, defend and indemnify Contractor and its suppliers, contractors and subcontractors of any tier from and against any and all claims, liability, and expense relating to such damage to or loss of the hole.
The Hole. In the event a hole is lost or damaged from causes other than the gross negligence of Contractor, Company shall be responsible for and hold harmless and indemnify Contractor from such damage to or loss of the hole, including all down hole property therein.
The Hole. COMPANY SHALL RELEASE, DEFEND, INDEMNIFY AND HOLD CONTRACTOR GROUP HARMLESS FROM AND AGAINST ANY CLAIMS ARISING OUT OF OR RELATING TO THE LOSS OR DAMAGE OF THE HOLE, INCLUDING THE CASING THEREIN,
The Hole. In the event a hole is lost or damaged from causes other than the gross negligence of Contractor, Operator shall be responsible for and hold harmless and indemnify Contractor from such damage to or loss of the hole, including all downhole property therein.
The Hole. In the event the hole should be lost or damaged at any time, Operator shall, except as provided in Paragraph 705(f), be responsible for and hold harmless and indemnify Contractor and its suppliers, contractors and subcontractors of any tier from such damage to or loss of the hole, including all downhole property therein.
The Hole. In the event the hole should be lost or damaged, Zion shall be solely responsible for such damage to or loss of the hole, including the casing therein; and shall bear the cost thereof, and Zion shall protect, defend, indemnify and save Contractor harmless in this regard; provided, however, that Zion shall have no liability for damages or loss resulting from gross negligence or willful misconduct of Contractor; and further provided that if any such loss or damage to the hole is caused by Contractor's sole gross negligence or willful misconduct, Contractor shall be obligated to redrill the hole to the depth at which the original hole was lost at rates that are 50% of Contractor's applicable price list at such time (as sole compensation to Zion).
The Hole. Except to the extent such loss or damage results from Contractor’s negligence, fault, or a defect in Contractor’s equipment, in the event the hole should be lost or damaged, Company shall release, protect, defend, indemnify and hold harmless Contractor from and against any and all claims, liability, and costs relating to such damage to or loss of the hole, including the casing therein and the cost to re-drill.
The Hole. The Company shall hold the Contractor harmless against any damage to or loss of the hole or casing therein, except where such loss or damage is caused by or results from the Contractor’s gross negligence and/or wilful misconduct and/or default and/or breach of duty (statutory or otherwise) or that of its affiliates, agents or sub-contractors and/or its or their personnel and, in such event, the Contractor’s liability, without prejudice to the Company’s rights under article 19.9, shall be limited either:
The Hole. In the event the hole should be lost or damaged, Operator shall be responsible for and hold harmless and indemnify Contractor from such damage to or loss of the hole, including all downhole property therein. Notwithstanding the foregoing, should such damage or loss occur as a result of Contractor’s sole negligence or willful misconduct, Operator at its sole discretion may require Contractor, as Operator’s sole remedy and Contractor’s exclusive liability for such sole negligence or willful misconduct, to re-drill the hole or portion thereof so lost or damaged at 65% of the Operating Rate; provided that such re-drill shall be considered operations in continuation of the existing well and shall not constitute a new well.
The Hole. Operator shall be solely responsible for damage to or loss of the borehole and other damage below the surface, including the casing. If such damage or loss was caused wholly or partially by the negligence or wilful misconduct of Contractor, its employees, agents or subcontractors, then Contractor shall at Operator’s direction, drill a new borehole in the same location or re-drill such section of the borehole as Operator may require at the Remedial Rate indicated in Appendix B.
