BASIC SERVICES; CONSTRUCTION PHASE. 4.1. Administration and Coordination of Construction Contract and Construction. CM will provide administrative, management and related services necessary to administer the Construction Contract for an Assigned Project, including, without limitation: (i) receive, review and forward to the District and the Architect the Contractor(s)’ Certificates of Insurance and Bonds along with commentary as to the extent to which the same comply with requirements of the Construction Contract; (ii) advice and recommendations to the District for issuance of Notice(s) to Proceed directing commencement of construction of the Assigned Project or portions thereof; issuance of the Notice(s) to Proceed on behalf of the District as directed or authorized by the District; (iii) scheduling, coordinating and conducting pre-construction and construction meetings; recording, maintaining and distributing minutes thereof; (iv) in consultation with the Architect, develop and implement procedures for the submittal and processing of Submittals; (v) in consultation with the District and the Architect, develop and implement procedures for the handling and disposition of the Contractor’s requests for information or clarifications; (vi) establish and implement procedures for the transmittal and receipt of communications, drawings and other information between CM, Architect and the Contractor relating to construction of the Assigned Project; (vii) assist the District in selection and retention of Test/Inspection Service Providers and the Project Inspector; (viii) review the Contractor’s Construction Schedules and implement provisions of the Construction Contract relating to the Contractor’s obligations for development, maintenance, updating and compliance with the Construction Schedule for the Assigned Project; and (ix) establish Site staging, lay down and storage areas. The CM’s Basic Services relating to Assigned Project communications shall utilize forms, processes and other measures implemented by the District in connection with construction of the Assigned Project, including without limitation, the eDocs web-based document control management system implemented by the District for the Assigned Projects.
BASIC SERVICES; CONSTRUCTION PHASE. 1. All of the Engineer’s Construction Phase Services (“Construction Phase Services”) as described in this Article 1, Section D Shall be performed on an “as requested” basis. The Contractor shall determine the level of effort required for such Services and pay for same on time and expense basis, as described in Addendum A. 2. The Engineer shall timely review and approve or otherwise respond to the Contractor’s submittals, including shop drawings, product data and samples, but only for the limited purpose of checking for conformance with information given by Engineer and the design concept expressed in the Construction Documents. Where requested by Contractor, Engineer shall review submittals for specific details but without any liability to Engineer arising from such review. Any detailed review shall not relieve Contractor of responsibility to construct the Project in accordance with the Issued for Construction Documents. The Engineer’s review shall not constitute approval of safety precautions or of construction means, methods, techniques, sequences or procedures. 3. The Engineer shall furnish interpretations and clarifications of the drawings and specifications, by means of additional drawings, addenda or otherwise, as are necessary for the proper execution and progress of the Project. All such interpretations and clarifications shall be consistent with the intent of the Construction Documents and reasonably inferable from them. 4. The Engineer shall communicate with the Owner and the Contractor’s subcontractors and suppliers only through the Contractor. 5. The Engineer shall have reasonable access to the Project site as necessary to perform the Construction Phase Services that are requested of it. 6. The Engineer shall visit the Project site as requested by Contractor or pursuant to such schedule as the Parties may establish, to become generally familiar with the quality of the construction. After each Project site visit, the Engineer shall promptly provide the Contractor with copies of all notes and field reports. Although the Engineer has no responsibility to discover defects or deficiencies in the construction, if the Engineer becomes aware of any such defects or deficiencies, it shall give prompt written notice to the Contractor. The Engineer shall not be responsible for construction means, methods, techniques, sequences or procedures, or for ensuring that the Contractor’s Work is in accordance with the Construction Documents. 7. BASIC SERVICES; CONSTRUCTION PHASE. The Contractor's basic --------------------------------- services following Owner's approval of the Fixed Price Agreement are described below. (1) The Contractor shall obtain necessary approvals of the Plans and Specifications by the governmental authorities having jurisdiction over the Project, which includes the obtaining of a building permit ("BUILDING PERMIT"), the cost for which shall be the obligation of Owner, which cost shall be set forth in the Fixed Price Agreement. Owner agrees that all permits necessary for the handling, processing and/or packaging of food products and/or which are mandated by health and food safety governmental department shall be the obligation of Owner to obtain, which permits are collectively referred to as "HEALTH/FOOD PERMITS." (2) During the course of construction, the Contractor shall prosecute the Work diligently to completion with the sufficient people on the job at all times and shall cooperate with and provide access and coordination for the electrical installation and preparation for and installation of equipment by contractors engaged directly by the Owner. (3) Unless otherwise provided in the Contract Documents, the Contractor shall pay for labor, materials, equipment, tools, construction equipment and machinery, water, heat, utilities, transportation and other facilities and services necessary for proper execution and completion of the Work. (4) The Contractor shall correct Work which does not conform to the Construction Documents, unless approved in writing by Owner. (5) The Contractor shall give notices and comply with laws, ordinances, rules, regulations and lawful orders of public authorities relating to the Project. (6) The Contractor at all times shall keep the Property and surrounding area free from dust which might become a nuisance to other property owners, accumulation of waste materials or rubbish caused by the operations under the Agreement. At the completion of the Work, the Contractor shall remove from and about the Project the Contractor's tools, construction equipment, machinery, surplus materials, waste materials and rubbish. If after first giving seven (7) days written notice to Contractor, the Contractor fails to clean up at the completion of the Work, the Owner may do so as provided in the Contract Documents, and the cost thereof shall be deducted from the Contract Sum.
