Private Elements definition

Private Elements means and includes the lot area upon which an apartment is located and the improvements located thereon, as described in the declaration, and for which fee simple ownership and exclusive use is reserved to that apartment only. Private elements shall exist only where each apartment in the project has a ground floor and there are no apartments located above or below the private element except the one (1) apartment located thereon. Limited common elements located upon private elements shall be deemed to be private elements;
Private Elements means and include the lot area upon which the unit is located. Exclusive ownership in fee simple and use of the Private Elements for each Unit is reserved to such Unit. The area of the Private Elements for each Unit is shown on the Plat. Lots, as referenced on the Plat, shall be deemed to refer to the Private Elements.
Private Elements means the part or parts of the Condominium Property intended for exclusive ownership by a Unit Owner;

Examples of Private Elements in a sentence

  • In addition, each Unit Owner shall be responsible for obtaining his own insurance insuring said Owner personally from liability in connection with the ownership, possession, use, and occupancy of his Unit and the Private Elements.

  • If approved by the IRC, once a Unit Owner encloses his Private Elements with a fence, the maintenance of such enclosed area shall be the responsibility of such Unit Owner.

  • Except as provided by the Act, no Owner shall by deed, plan, court decree or otherwise, subdivide or in any other manner cause his Unit or its Private Elements to be separated into any tracts or parcels different from the whole Unit and its Private Elements as shown on the Site Plan.

  • All playground equipment located upon the Lots or Private Elements, including but not limited to, swing sets, slides, seesaws, playhouses, and/or climbing apparatuses, shall be maintained in good condition, constructed of natural wood (or other material approved by the IRC).

  • Lots and, if applicable, Private Elements, are to be landscaped and maintained in an attractive manner that is compatible with neighboring Lots and Private Elements and respectful of views and privacy of adjacent Owners and consistent with the Community-Wide Standard.

  • In addition, the following provisions shall govern the construction and installation of all Improvements upon the single family residential Lots or Unit Pads, Units or Private Elements within the Development Property.

  • All Owners acknowledge and understand that Declarant and Builders will be constructing/renovating portions of the Development Property and engaging in other construction activities related to the construction of Common Areas, Improvements, Units, and related Common Elements, Limited Common Elements and Private Elements.

  • Flowers, hedges, shrubs, trees, and other vegetation may be planted in the rear yard without IRC approval; however, Owners shall replace in a diligent manner any vegetation on their Lot or Private Elements that should die.

  • The following use restrictions apply to all Lots, Units, Private Elements and Improvements constructed thereon within the Development Property.

  • Notwithstanding the foregoing, in the event a Unit Owner’s lawn is enclosed by a fence or landscaping is installed by a Unit Owner within the Private Elements or Limited Common Elements appurtenant to that Unit, then the enclosed lawn or installed landscaping shall thereby be considered a “Limited Common Element” and the Unit Owner shall thereafter be responsible for the maintenance of the enclosed lawn or the installed landscaping.


More Definitions of Private Elements

Private Elements means the dwelling unit which consists of that part of the building containing the unit which lies within the boundaries of the unit, exclusive of interior load bearing walls and pillars and any pipes, wires, conduits, ducts, vents and other servicing utility lines, which are utilized for or serve more than one condominium unit. The vertical boundaries of each unit shall be the plane of the inside surfaces of the studs which are the component parts of exterior walls and of interior walls separating a unit from another unit and are as shown on the plats and plans of the condominium. Where the unit is bound by an exterior wall, the walls shall be considered to include the door, window or other closure therein in the closed position, the boundary shall be the plane of the inside surfaces of the studs which are the component parts of such walls to the effect that the private elements of the boundary walls shall include the surfacing materials. The upper horizontal boundary of each unit shall be the plane of the under surfaces of the ceiling slabs. The lower horizontal boundary of floors of the units shall be the upper surface of the floor slab. An Owner shall not be deemed to own the studs and structural components of the perimeter walls and/or of load bearing walls, nor the windows and doors bounding the unit, nor balconies, nor balcony railings enclosing a balcony area assigned to exclusive use of the unit. An Owner, however shall be deemed to own and shall have the exclusive right and duty to repair, maintain, replace paint, repaint, tile, wax, paper or otherwise finish and decorate the surfacing materials on the interior of exterior walls and on the interior walls separating a unit from other units, and the surfacing material of the floors of his unit, and all appurtenant installations including all pipes, ducts, wires, cables and conduits used in connection therewith for services such as power, light, telephone, sewer, water, HVAC, and TV, whether located in the boundaries of the unit or in the common areas, which are for the
Private Elements means the parts of the Condominium Property as set forth in the Plan intended for the exclusive ownership and possession by an Owner. Each Private Element is identified in a diagrammatic floor plan as shown on the Plan and shall consist of the volumes or cubicles of space which lie between the lower, upper and lateral or perimetrical boundaries described as follows:
Private Elements means and refer to any and all parcels of real estate shown upon any recorded map of The Properties upon which a Home or Unit and the improvements associated therewith will be located and for which fee simple ownership and exclusive use is reserved to that Home or Unit only, and fee simple ownership thereof may be conveyed.
Private Elements or “Unit” shall mean the parts of the Condominium Property as set forth in the Plan intended for the exclusive ownership and possession by an Owner. Private Elements means private areas and facilities as defined in said Act, and intended for exclusive ownership or possession by a unit owner.

  • Private entity means any entity other than a State, local government, Indian tribe, or foreign public entity, as those terms are defined in 2 CFR 175.25. Includes:

  • Private Key means the key of a key pair used to create a digital signature;

  • apartment building means a residential use building, or the residential use portion of a mixed-use building, other than a townhouse or stacked townhouse containing four or more dwelling units each of which shall have access to above grade common halls, stairs, elevators, and yards;

  • private sewer means a pipe or pipes which drain foul or surface water, or both, from premises, and are not vested in a Sewerage Undertaker;

  • Private club means an organization, whether incorporated or not, which is the owner, lessee, or occupant of a building or portion thereof used exclusively for club purposes at all times, which is operated solely for a recreational, fraternal, social, patriotic, political, benevolent, or athletic purpose, but not for pecuniary gain, and which only sells alcoholic beverages incidental to its operation. The affairs and management of the organization are conducted by a board of directors, executive committee, or similar body chosen by the members at an annual meeting. The organization has established bylaws and/or a constitution to govern its activities. The organization has been granted an exemption from the payment of federal income tax as a club under 26 U.S.C. Section 501.

  • Private employer means any person, company, corporation, labor organization or association which employs ten or more persons.

  • Private event means a social gathering or event attended

  • Tower means any structure built for the sole or primary purpose of supporting any FCC-licensed or authorized antennas and their associated facilities, including structures that are constructed for wireless communications services including, but not limited to, private, broadcast, and public safety services, as well as unlicensed wireless services and fixed wireless services such as microwave backhaul, and the associated site.

  • Public works project means the erection, construction, alteration, repair, or improvement of any public structure, building, road, or other public improvement of any kind.
