Oversized Facilities definition

Oversized Facilities means water, sewer, and/or drainage facilities sized to serve areas outside the District or constructed to serve areas outside the District, as more fully described in Section 2.04.
Oversized Facilities means utility facilities sized beyond the needs of the development for which the facilities were initially installed or are to be installed to provide service.
Oversized Facilities means those portions of Water System Facilities required by Authority of greater capacity, size or length than would be necessary to provide the service requested by the Applicant.

Examples of Oversized Facilities in a sentence

  • The District will make every effort to properly evaluate the cost difference estimate for the Oversized Facilities, but in the event of a disagreement that cannot be resolved, the decision of the District Manager will be final.

  • In such event, the property owner may elect to defer the development of the Development Project until the District elects, in its sole discretion, to construct sufficient off-site facilities to accommodate the Development Project, or the property owner can voluntarily elect to construct the Oversized Facilities.

  • The District does not represent to the property owner, and the property owner may not rely on the assumption, that sufficient other District charges to connect to the Utility System will be assessed to fully offset the Oversized Facilities credit, and any Oversized Facilities credit will lapse and be extinguished without refund or reimbursement upon build-out of the Development Project.

  • If the property owner elects to construct Oversized Facilities, the District shall provide the property owner a credit for the Oversized Facilities that may be used by the property owner to offset any other District charges for itself or Customers within the Development Project to connect to the Utility System (e.g., connection fees, meter installation charges, etc.).

  • To the extent that the District has issued a credit to a property owner for Oversized Facilities, and such off-site Facilities benefit a subsequent property owner requesting service from the District, the District may require the subsequent property owner, as part of its off-site Facilities requirement, to reimburse the District for its pro-rata share of such previously issued credit to the extent benefitted.

  • An Applicant whose Project(s) require or will utilize a portion of previously constructed Oversized Facilities shall pay Authority a participation payment based on a proration of the Applicant’s project(s)’ demand relative to the total capacity of previously installed Oversized Facilities or other appropriate proration as determined by the Authority.

  • The amount of the Oversized Facilities credit shall be determined by the District based upon the actual construction cost of the Oversized Facilities that are verified by the engineer for the property owner and estimated cost of the Minimum Size facilities as of the completion of construction of the Oversized Facilities, as determined by the District.

  • The District does not represent to the Developer and Developer may not rely on the assumption that sufficient other District charges to connect to the utility system will be available to fully offset the Oversized Facilities credit, and any Oversized Facilities credit will lapse and be extinguished without refund or reimbursement upon build-out of the Developer’s property.

  • The District shall prepare the Oversized Facilities credit based upon the estimated difference in the cost of construction of the Oversized Facilities and the Minimum Size facilities which the Developer would otherwise have required for its own use.

  • In those cases where two or more Applicants make a joint advance or contribution on the same Oversized Facilities, the Authority shall distribute reimbursements to such Applicants in the same proportion as their advances or contributions bear to the joint total, unless otherwise directed by all parties.

Related to Oversized Facilities

  • Related facilities means any ancillary facilities owned by the Company which are —

  • Generating Facilities means Interconnection Customer’s device for the production and/or storage for later injection of electricity identified in the Interconnection Request, but shall not include the Interconnection Customer’s Interconnection Facilities. Generation Interconnection Customer:

  • Authorized Facilities means the public facilities authorized to be financed, in whole or in part, by the CFD.

  • Production Facilities (7 9) means "production equipment" and specially designed software therefor integrated into installations for "development" or for one or more phases of "production".

  • Shared Facilities means the gentie lines, transformers, substations, or other equipment, permits, contract rights and obligations, and other assets and property (real or personal), in each case, as necessary to enable delivery of energy from Seller’s electric generating facility (which is excluded from this definition of Shared Facilities) to the Point of Interconnection that are used in common with other entities, as applicable.

  • Parking Facilities means parking lots or other off-street areas for the parking of vehicles, including areas below or above the surface of streets.

  • Generating Facility means the Generating Unit(s) comprising Seller’s power plant, as more particularly described in Section 1.02 and Exhibit B, including all other materials, equipment, systems, structures, features and improvements necessary to produce electric energy and thermal energy, excluding the Site, land rights and interests in land.

  • Railroad facilities means right of way and related

  • Public facilities means amenities that are—

  • Interconnection Facilities means the Transmission Owner Interconnection Facilities and the Customer Interconnection Facilities.

  • Common Facilities means the facilities under D.G.sets/D.G.rooms, water storage tanks its pumping and supply system, sewerage & drainage systems, electric sub-station/ transformers/electric panels/distribution network, maintenance service rooms, lawns including lighting & services etc., roads, pathways & driveways including street lighting & services etc., guard posts, fire hydrants & fire fighting system etc. and all such facilities and areas for common use and excluded from the computation of Super Area of the Said Premises;

  • Other Facilities means athletic stadiums, swimming pools, any associated structures or related equipment tied to such facilities including, but not limited to, grandstands and night field lights, greenhouses, facilities used for non-instructional or non-educational purposes, and any structure, building, or facility used solely for school administration;

  • Wastewater facilities means the structures, equipment, and processes required to collect, carry away, and treat domestic and industrial wastes and dispose of the effluent.

  • Project Facilities means any facilities to be constructed, provided, rehabilitated, operated and/or maintained under the Project;

  • Existing Facilities means all existing buildings and other facilities, the sites for the buildings or facilities, and furnishings or equipment for the buildings or facilities located on real property acquired by the building authority under the terms of this act.

  • Facilities means the Plant and Equipment to be supplied and installed, as well as all the Installation Services to be carried out by the Contractor under the Contract.

  • Vending facility means automatic vending machines, cafeterias, snack bars, cart service, shelters, counters, and such other appropriate auxiliary equipment which may be operated by licensed managers and which is necessary for the sale of newspapers, periodicals, confections, tobacco products, foods, beverages, and other articles or services dispensed automatically or manually and prepared on or off the premises in accordance with all applicable health laws and including the vending or exchange of chances for any lottery authorized by State Law and conducted by an agency of a State within such State.   • LNG facility means a terminal which is used for the liquefaction of natural gas or the importation, offloading, and re-gasification of LNG, and includes ancillary services and temporary storage necessary for the re-gasification process and subsequent delivery to the transmission system, but does not include any part of LNG terminals used for storage;

  • New Facilities means facilities for which, by the cut-off date, neither of the following events has occurred:

  • Local Facilities means working capital facilities provided to a Grantor (other than Beverage Packaging Holdings (Luxembourg) I S.A., Beverage Packaging Holdings (Luxembourg) II S.A. Beverage Packaging Holdings (Luxembourg) III S.à.x.x. and the Borrowers) by a Local Facility Provider and “Local Facility” means any of them.

  • Transportation Facilities means any physical facility that moves or assist in the movement of people or goods including facilities identified in OAR 660-012-0020 but excluding electricity, sewage, and water systems.

  • Facility Site shall have the meaning set forth in the recitals to the Facility Site Lease.

  • Idle facilities means completely unused facilities that are excess to the governmental unit's current needs.
