Warranty Exclusion. This Limited Warranty only applies to defects in materials and workmanship under normal use during warranty period or Defective on Arrival (“DOA”), however, does not apply to following cases:

TRT shall not liable whatsoever for any damage caused by misuse, neglect, improper operation, improper maintenance installation by a third party, modification or adjustment or fair wear and tear.

EXCEPT AS (1) REQUIRED BY APPLICABLE LAW, (2) EXPRESSLY SET FORTH IN THESE CONDITIONS OR (3) SPECIFICALLY PROVIDED TO THE CUSTOMER BY HILL’S PET NUTRITION IN WRITING, HILL’S PET NUTRITION DISCLAIMS AND EXCLUDES ALL WARRANTIES AND TERMS AND CONDITIONS NOT CONTAINED IN THESE CONDITIONS, EXPRESS OR IMPLIED, TO THE FULLEST EXTENT PERMITTED BY LAW AND SPECIFICALLY DISCLAIMS, WITHOUT LIMITATION, ALL IMPLIED WARRANTIES OF REASONABLE QUALITY OR MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE AND NON-INFRINGEMENT.
Warranty Exclusion. NEITHER PARTY PROVIDES ANY WARRANTY WHATSOEVER TO THE OTHER PARTY WITH RESPECT TO THE DEVELOPED TECHNOLOGY. Nothing contained in this Agreement shall be construed as a warranty or representation by either party that any manufacture, use, sale, lease or other disposition of the Developed Technology will be free from infringement of any patent or other proprietary right of any third party.
Warranty Exclusion. Dell makes no warranty, either express or implied, including, but not limited to, any implied warranties of merchantability and fitness for a particular purpose. Dell expressly disclaims all warranties.

EXCEPT FOR WARRANTIES EXPRESSLY MADE IN THIS AGREEMENT, WILDCARD MAKES NO REPRESENTATIONS OR WARRANTIES, EXPRESS OR IMPLIED, TO CLIENT, ANY CARDHOLDER, OR TO ANY OTHER PERSON, INCLUDING, WITHOUT LIMITATION, ANY WARRANTIES REGARDING THE MERCHANTABILITY, SUITABILITY, ORIGINALITY, QUALITY, FITNESS FOR A PARTICULAR PURPOSE, NONINFRINGEMENT OR OTHERWISE (IRRESPECTIVE OF ANY PREVIOUS COURSE OF DEALINGS BETWEEN THE PARTIES OR CUSTOM OR USAGE OF TRADE), OR RESULTS TO BE DERIVED FROM THE USE OF ANY SOFTWARE, SERVICES, HARDWARE OR OTHER MATERIALS PROVIDED UNDER THIS AGREEMENT. If this Agreement includes or refers to any economic models, pro formas, or projections of any kind, it is understood that WildCard makes no express or implied warranty with respect to such economic models, pro formas, or projections, including without limitation any warranty of feasibility, profitability or results.
Warranty Exclusion. With the exception of the warranties expressly mentioned in the Agreement, all Services are provided "as is". EasyMovie makes no other warranties, whether express or implied, statutory or otherwise, and in particular EasyMovie makes no implied warranty of merchantability, fitness for a particular purpose, ownership or non-infringement, and any other guarantees that interfere with business reports or business practices. With the exception of the warranties expressly mentioned in this Agreement, EasyMovie does not provide any other warranty that the Services or the results obtained from their use, will comply with Customer's expectations, will operate without interruption, will achieve an expected result, will be compatible or will work with software, systems or other services or will be secure, accurate, complete, harmless or error-free.
Warranty Exclusion. ACCESS TO THE BACK PLANTS AND ALL INFORMATION OBTAINED THROUGH THEM, WHETHER GENERATED BY FNT OR A PROVIDER, ARE LICENSED TO EACH CUSTOMER "AS IS". FNT ASSUMES NO DUTY TO CONTINUE TO AUGMENT, CORRECT OR REMOVE ANY INACCURATE INFORMATION OR NOTIFY CUSTOMERS OF ERRORS IN THE BACK PLANTS. EACH CUSTOMER ASSUMES FULL RESPONSIBILITY FOR THE TANGIBLE AND BUSINESS RESULTS OF USE AND/OR RELIANCE UPON THE BACK PLANTS AND ANY OTHER FNT PROPERTY. NEITHER FNT NOR ITS PROVIDERS MAKE ANY IMPLIED WARRANTY OR REPRESENTATION, INCLUDING WARRANTIES OF MERCHANTABILITY OR FITNESS FOR A PARTICULAR PURPOSE, ACCURACY OR COMPLETENESS OF BACK PLANTS, OR ANY OTHER FNT PROPERTY MADE AVAILABLE TO ANY CUSTOMER.
