VACATION PAY FOR MEMBERS OF LOCAL. (a) Local and the Association agree to create and establish a jointly administered trust fund to be known as the "Operating Engineer, Local Members Holiday and Vacation with Pay subject to 4 below. Vacation with Pay at the rate of ten percent of gross earnings shall be paid to the Vacation with Pay Trust Fund on behalf of employees covered by this Collective Agreement who are members of Local It is understood and agreed by the parties that the establishment of this Trust Fund, as set out in 4 (a) above is contingent on the establishment of said fund in conjunction with at least one other employer's association. (a) The Employer and Local agree to be bound by the terms and conditions of the Labourers’ Local Members Holiday and Vacation with Pay Trust, as if original parties thereto and agree to be bound by any additions, alterations or amendments of the said Trust, as if original parties thereto and as if the same formed part of this Collective Agreement. The parties hereto agree to execute any and all necessary documentation that may be necessary to facilitate the appointment of one (I) Trustee on behalf of the Association to the said Vacation with Pay Fund. VACATION PAY FOR MEMBERS OF LOCAL. Vacation and Statutory Holiday Pay shall be credited weekly to each employee, who is a member of Local covered by this Collective Agreement, at the rate of of the gross wages and income tax will be deducted weekly. It is understood and agreed that of the gross wages is to be considered Vacation Pay and of 'the gross wages is to be in lieu of Statutory Holiday Pay. It is further understood that Vacation Pay and Statutory Holiday Pay credits will be paid to employees on termination and on the first pay day of March, June, September and December of each year. The Employer and Local agree to execute any and all documents that may be necessary to facilitate this payment by the trustees.
