Subject to 4 Clause Samples

The 'Subject to 4' clause establishes that the provisions or obligations referenced are conditional upon the terms set out in clause 4 of the agreement. In practice, this means that any rights, duties, or actions described in the current section will only apply if they are consistent with, or not overridden by, the stipulations found in clause 4. For example, if clause 4 contains specific limitations or exceptions, those will take precedence over the general terms elsewhere. This clause ensures that there is a clear hierarchy within the contract, preventing conflicts and ensuring that the most specific or controlling provisions are applied.
Subject to 4. 2.6, a Board may require an employee covered by this agreement to attend professional development opportunities for up to five days in each calendar year. The identification of such opportunities is likely to arise from the process referred to in 4.2.2.
Subject to 4. 4.1 the employee shall work during meal breaks at ordinary rates of pay whenever instructed to do so for the purpose of making good breakdown of plant or upon routine maintenance of plant which can only be done while the plant is idle.
Subject to 4. 1.1 and 4.1.2 above, the employer shall give to an employee a period of notice of termination in accordance with the following scale or by payment in lieu thereof: Period of Continuous Service Period of Notice Less than 2 years At least 2 weeks 2 years and less than 3 years At least 3 weeks 3 years and less than 5 years At least 4 weeks 5 years and beyond At least 5 weeks
Subject to 4 a. hereinafter, leave taken intermittently or on a reduced leave schedule must be agreed upon by the Superintendent under 2.a.; for 2.b. or c. such leave must be medically necessary.
