Utility Approvals. Notwithstanding that Provider shall have the primary responsibility for preparing applications and obtaining all permits, licenses and approvals required for the performance of work under this Agreement, Customer agrees to assist Provider in obtaining necessary permits, licenses and approvals in connection with the installation, operation and maintenance of the System, including the submission of applications for interconnection of the System with the local electric utility. Customer shall not make any material changes to its electrical equipment at any Site after the date on which the applicable utility interconnection application is submitted unless any such changes, individually or in the aggregate, would not adversely affect the approval by such utility of such interconnection. Should the local electric utility fail to approve the interconnection of the System or require equipment in addition to the equipment set forth in Exhibit A, Provider may, at Provider’s option, terminate this Agreement immediately subsequent to notification from the local utility. The Parties shall not be obligated to go forward with installation of the System at the Site if the applicable utility approvals are conditioned upon material upgrades to the existing electrical infrastructure and neither Party elects to provide for such upgrades.

Customer shall not make any material changes to its electrical equipment at the Site after the date on which the applicable utility interconnection application is submitted unless any such changes, individually or in the aggregate, would not adversely affect the approval by such utility of such interconnection. Should the local electric utility fail to approve the interconnection of the System or require equipment in addition to the equipment set forth in Schedule B in connection with the Site, Provider may, at Provider’s option, terminate this Agreement immediately subsequent to notification from the local utility. The Parties shall not be obligated to go forward with installation of the System if the applicable utility approvals are conditioned upon material upgrades to the existing electrical infrastructure and neither Party elects to provide for such upgrades. Customer also agrees to assist Provider and make all necessary repairs or changes to the existing electrical infrastructure so that the Site and System are eligible for the Environmental Financial Incentives.
Utility Approvals. System interconnection with the Network must comply with Utilities’ interconnection protocols as set forth in the Fort Xxxxxxx City Code and interconnection standards. Owner will be responsible to have current licenses and all permits to do the work indicated. Owner shall be responsible for any taxes or fees involved in constructing the System.
Utility Approvals. Xxxxxx’s receipt of evidence satisfactory to Lender of all appropriate approvals for/from public water, public natural gas, public electricity, public sewer, cable, telephone, and any and all other utility company approvals, for the development of the Property and the installation of said utilities. ● Flood Insurance. Evidence that the requirements, if applicable, of the Federal Flood Insurance Program have been satisfied.

Provider shall make all reasonable improvements required by the local electric utility. Should the local electric utility fail to approve the interconnection of the System with respect to the Site or require equipment in addition to the equipment set forth in Schedule B of Appendix I, Provider may, at Provider’s option, terminate this Agreement in whole immediately subsequent to notification from the Utility. Provider shall provide Host with reasonable advance notice of any testing of the System required for utility approval with enough time that Host may elect to observe the testing.

The Parties shall not be obligated to go forward with installation of the System at the Site if the applicable utility approvals are conditioned upon material upgrades to the existing electrical infrastructure beyond what is contemplated by Section 3.1 hereof and neither Party elects to provide for such upgrades. The System shall comply with the applicable Institute of Electrical and Electronic Engineers rules for interconnected distributed generation systems and shall be compliant with the National Electrical Code and relevant State and local building codes. System interconnection with the local electric utility grid must comply with the interconnection protocols of the local electric utility. Provider will be responsible to have current licenses and shall apply for all permits required to do the work indicated and must provide these licenses before a notice to proceed is issued. Provider shall be responsible for any taxes or fees involved in constructing this project.
