Supplemental Schedule of Performance. Developer shall diligently and continuously proceed to implement the AHA by using its reasonable, best efforts, among other actions, to obtain all design and building approvals in accordance with the AHA, and to construct or cause construction of the Project in accordance with the Development Plans approved by Authority pursuant to the AHA. Developer shall develop the Project within the times set forth in the Supplemental Schedule of Performance attached hereto as Exhibit E and incorporated herein.

Supplemental Schedule of Performance. Phase A Developer shall diligently and continuously proceed to implement the Original Agreement by using its reasonable, best efforts, among other actions, to obtain all design and building approvals in accordance with the Original Agreement, and to construct or cause construction of Phase A of the Project in accordance with the Development Plans approved by Authority pursuant to the Original Agreement. Phase A Developer shall develop Phase A of the Project within the times set forth in the Supplemental Schedule of Performance attached hereto as Exhibit E and incorporated herein. Parcel Map. Prior to and as a Condition Precedent to the provision of the Phase A Appropriation, Phase A Developer and Phase B Developer shall have obtained City and Authority approval of (for later recordation against the Phase A Site and the Phase B Site upon and immediately after approval of such map by the County) an air rights subdivision parcel map which subdivides the Site into three parcels, including two above-ground air space parcels corresponding to the Phase A Site and the Phase B Site and a third parcel which shall have the same boundaries as the Site but shall extend below ground under the entire Site, which subterranean parcel shall be the location of a two-story subterranean parking structure to be used by both Phases of the Project (―Parcel Map‖). The two above-ground parcels (corresponding to the Phase A Site and the Phase B Site) must conform to City Planning Department requirements, lender requirements, and other requirements imposed by funding sources for each Phase of the Project. The Parcel Map must comply with the requirements of the Subdivision Map Act and be approved by the Anaheim Planning Commission at a noticed public hearing. The REA (as described in Section 3.4) shall be recorded in a first, senior and non-subordinate position against the entire Site in connection with the Parcel Map and the Parcel Map and REA shall each include cross references to and incorporate the other document. Recordation of the Parcel Map shall be contingent upon prior or concurrent recordation of the REA against the entire Site. Related to Supplemental Schedule of Performance

  • Schedule of Performance Consultant shall commence the services pursuant to this Agreement upon receipt of a written notice to proceed and shall perform all services within the time period(s) established in the “Schedule of Performance” attached hereto as Exhibit “D” and incorporated herein by this reference. When requested by the Consultant, extensions to the time period(s) specified in the Schedule of Performance may be approved in writing by the Contract Officer but not exceeding one hundred eighty (180) days cumulatively.

  • Wage Schedules The Parties shall, upon completing a wage adjustment calculation, forthwith prepare, publish, post and distribute a wage schedule resulting therefrom. The final determination of the wage schedules shall be issued no later than the 7th day of March or September, for the May and November adjustments, respectively.

  • Time of Performance Time for performance of the Scope of Services under this Agreement shall begin with receipt of the Notice to Proceed and end no later than December 31, 2026. Consultant shall complete the tasks described in the Scope of Services, within this time or within such additional time as may be extended by the County.

  • Manner of Performance Subject to the provisions of Article XII hereof, the Contractor shall perform all of the Work described in the Statement of Work, or cause such Work to be performed in an efficient and expeditious manner and in accordance with all of the terms and provisions of this Agreement. The Contractor shall perform the Work in accordance with the current professional standards and with the diligence and skill expected for the performance of work of the type described in the Statement of Work. The Contractor shall furnish such personnel and shall procure such materials, machinery, supplies, tools, equipment and other items as may reasonably be necessary or appropriate to perform the Work in accordance with this Agreement.

  • Warranty of Performance Contractor represents and warrants that it possesses the knowledge, skill, experience, and financial capability required to perform and provide all Services and that each person and entity that will provide Services is duly qualified to perform such services by all appropriate governmental authorities, where required, and is sufficiently experienced and skilled in the area(s) for which such person or entity will render such Services. Contractor represents and warrants that the Services shall be performed in a skillful and respectful manner, and that the quality of all such services shall equal or exceed prevailing industry standards for the provision of such services.

  • Time Schedule 4.1. A project schedule is included in Appendix A.

  • Assessment of Performance The assignment of a teacher to a TLS position will be subject to review by the school district’s administration at least annually. The first review must be completed no later than five (5) work days before the beginning of the transfer process. The review shall include peer feedback on the effectiveness of the teacher’s performance of duty specific to the teacher’s TLS position. A teacher who completes an assignment in a TLS position may apply for assignment to a new TLS position.
