(a) Upon timely request, the Department of Administrative Services shall make available at no cost to the Union the latest copy of any SEIU Local 503, OPEU bargaining unit employee statistical and expenditure reports relative to employment and benefits currently produced by the Department of Administrative Services which do not require manual or machine editing to remove confidential data or non-SEIU Local 503, OPEU bargaining unit employee data. Such request must be made in advance of the preparation of the reports. If new and appropriate employee statistical and expenditure reports are produced by the Department of Administrative Services, the Department and the Union may mutually agree in advance to provide such reports at no cost.

Section 14. 32 The bargaining unit to which this Agreement is applicable shall consist of all classified employees in 33 the following general job classification: Secretarial-Clerical; except: Secretaries/Clerks to/for the 34 Superintendent, Assistant Superintendents, Executive Directors and Human Resources Directors, 35 provided however, that the number of excluded secretaries/clerks shall not exceed thirteen (13) FTE. 36 37 39 A R T I C L E I I 40 41 RIGHTS OF MANAGEMENT 42 43 Section 2.1. 44 It is agreed that the customary and usual rights, powers, functions, and authority of management are 45 vested in management officials of the District. Included in these rights in accordance with and subject 46 to applicable laws, regulations, and the provisions of this Agreement, is the right to direct the work 47 force, the right to hire, promote, retain, transfer, and assign employees in positions; the right to 48 suspend, discharge, demote, or take other disciplinary action against employees; and the right to 1 release employees from duties because of lack of work or for other legitimate reasons. The District 2 shall retain the right to maintain efficiency of the District operation by determining the methods, the 3 means and the personnel by which operations undertaken by the employees in the unit are to be 4 conducted.
Section 14. 2. Section 14.2 of the Agreement is hereby deleted and replaced as follows:
Section 14. 8 The bargaining unit to which this Agreement is applicable shall consist of all classified employees in 9 the following general job classifications: Child Nutrition Services, Custodial, Paraeducators, Grounds, 10 Trades, and Warehouse (includes Laundry). Nothing within this Agreement pertains to employees not 11 employed on a regular basis.
Section 14. 1. 13 Grievances or complaints arising between the District and its employees within the bargaining unit or the 14 Association defined in Article I herein, with respect to matters dealing with the interpretation or 15 application of the terms and conditions of this Agreement, shall be resolved in strict compliance with this 16 Article.
