Removal of Personalty. At the termination of this permit, Permittee shall remove all of its personal property from the premises and return the premises to its condition existing at the commencement of this permit. On termination, if Permittee fails to return the Premises to its condition existing at the commencement of this Permit, Permittee agrees to pay to the City on demand, all costs incurred by City to return and restore the Premises to its original condition. The Permittee shall remove all personalty from the premises within two (2) days of the termination of this permit, and in the event of failure to do so, City will impose a charge on Permittee for same.

Removal of Personalty. At the expiration of the Lease Term, and if Lessee is not then in breach hereof, Lessee may remove all Personalty from the Properties. Lessee shall repair any damage caused by such removal and shall leave the Properties broom clean and in good and working condition and repair inside and out, normal wear and tear excepted. Any property of Lessee left on the Properties on the tenth day following the expiration of the Lease Term shall, at Lessor's option, automatically and immediately become the property of Lessor.

At the expiration of the Lease Term, and if Lessee is not then in breach of this Lease, Lessor agrees that Lessee, at Lessee's sole expense, may, within nine Business Days after such expiration, make such modifications and alterations, including removal of all distinctive physical and structural features associated with the trade dress of Cracker Barrel Old Country Store® units, Xxxxx'x Roadhouse® units and Xxxxxxx Xxxxxxxx'x Gourmet Market™ units, as may be necessary to distinguish the Property so clearly from its former appearance and from other Cracker Barrel Old Country Store® units, Xxxxx'x Roadhouse® units and Xxxxxxx Xxxxxxxx'x Gourmet Market™, as to prevent any possibility that the public will associate the Property with Cracker Barrel Old Country Store® units, Xxxxx'x Roadhouse® units and Xxxxxxx Xxxxxxxx'x Gourmet Market™ units, and any confusion created by such association. (Such modifications and alterations shall include, but not be limited to, removing or covering the distinctive decor and color scheme on all walls, counters, fixtures and furnishings, as well as the exterior of the Property.).

If Lessee fails or refuses to remove all such personal property from the Premises within thirty (30) days after Lessor gives notice to do so, all such personal property shall automatically become the property of Lessor. Lessor may then remove the personal property from the Premises in any manner that Lessor shall choose, and Lessor may retain, abandon, sell, dispose of, donate or give to anyone any part or all of the personal property or otherwise deal with it as Lessor's property, all in Lessor's sole discretion and without liability for loss or damage. Lessee shall pay Lessor on demand one-thirtieth (1/30th) of the monthly Base Rent last in effect for each day from the date the Lease term Expires through the date the last of Lessee's personal property is removed pursuant to this paragraph or the date such personal property becomes the property of Lessor pursuant to the terms of this Section 22, and Lessee shall pay Lessor, on demand, any and all expenses incurred by Lessor in removing any abandoned personal property, including, without limitation, moving and transportation charges. Lessor may, at its option and without notice, sell the personal property, or any part of it at public or private sale and without legal process, for such price as Lessor may obtain, and apply the proceeds of such sale to any amounts due from Lessee under this Lease.
