Public Safety Site. The obligations of the City under this Agreement are expressly conditioned upon the Developer’s conveyance of that certain 5.3 acre tract of land ("Public Safety Site") as legally described in Exhibit B-1 and as depicted on Exhibit B-2 attached hereto, which Public Safety Site is anticipated to be developed by the City for the construction of, and use as, a public safety facility (subject to the restrictions set forth in Section 10.06(a) hereof). The Closing on the Public Safety Site shall occur on or before the Closing Date set forth in Section 10.01 hereof.

Public Safety Site. The City has previously been conveyed approximately three and 83/100ths (3.83) acres of land to be utilized as a Public Safety site (the “Public Safety Site”). Such Public Safety Site has been provided in a location to be able to provide public safety services and other municipal services to residents and others located upon the Property in an efficient manner. It is specifically acknowledged that the obligation as to the Public Safety Site was three (3) acres, and that Owner’s obligation for the Public Safety Site has been satisfied with respect to Public Safety Site that will serve the Property south of Exit #3. In order to service the area north of Exit #3, the Owner shall convey to the City an additional three (3) acres of land for a second Public Safety Site to be constructed by the City (the “North Public Safety Site”). The City and Owner shall mutually agree upon the location of the North Public Safety Site and the City may choose to combine the North Public Safety Site with dedications from the Owner for other public infrastructure to maximize utilization of resources. Additional protection for the industrial or commercial sites may become required based upon actual build, and suitable arrangements for additional contributions may be required to be provided by Owner. All Development Fees for Public Safety as hereafter provided shall be placed in a segregated interest bearing account (“Public Safety Fund”). Owner consents that any Development Fees for Public Safety purposes may be available for both land acquisition, construction and equipment costs for Public Safety facilities upon the site or sites, and debt service, if any, in connection with a Public Safety Financing District, as defined below. Upon completion of the two Public Safety Sites described herein, the City shall be entitled to utilize any excess funds in such account which are not needed in connection with the initial acquisition, construction, equipping and debt servicing, if any, of such site(s) in conjunction with other Developer Fees to mitigate impacts relating to the Property.
Public Safety Site. The Public Safety Site may be located within the Commercial/Mixed Use area of the Master Plan, or at Owner's discretion and with County approval of the location, the Public Safety Site may be located outside of the Osprey Point Master Plan, on land to be acquired by Owner and donated to the County. The area to be donated for a Public Safety Site shall be 1/2 acre, sufficient for a Fire/EMS facility.
Public Safety Site. The Public Safety Site shall be located within the Commercial/Mixed Use area of the Master Plan. The area to be donated for a Public Safety Site shall be 1/2 acre, sufficient for a Fire/EMS facility, rather than the one acre site originally provided under Section IV(K) of the Development Agreement. Required drainage and open space for the public safety site shall be provided on the adjacent Commercial Area of Owner, so that the 1/2 acre site shall be a buildable area footprint.

  • Site Safety Buyer shall comply with all federal, state, and local safety regulations and standards applicable to the Site and to the Equipment on which Siemens will perform the Services. Siemens shall not be obligated to commence or perform Services unless Buyer’s Site complies with all applicable safety requirements. In the event Buyer’s Site safety is non- compliant, Siemens may suspend the Services until such time as Buyer corrects the non-compliance. To the extent Siemens incurs additional time and expense as the result of Buyer’s non-compliance, Siemens shall be entitled to an equitable adjustment in the schedule, price and other affected provisions of the Agreement.

  • Child Safety Never leave a child unsupervised near a pool, not even for a second. During social gatherings at or near the pool, appoint a designated adult to protect young children from pool accidents. Children must be watched closely while swimming. Do not use floatation devices as a substitute for supervision. Toys can entice young children into the pool area. When not in use, clear the pool area of all toys.

  • Fire, Life Safety, and Accessibility Codes The following codes, in the versions approved by the Georgia State Fire Marshal/Fire Safety Commissioner and Department of Human Resources, shall be used. The Design Professional will designate any additional codes or special modifications in the Supplementary General Conditions.

  • Prescription Safety Glasses Prescription safety glasses will be furnished by the employer. The employer retains the authority to establish reasonable rules and procedures regarding frequency of issue, replacement of damaged glasses, limits on reimbursement costs and coordination with the employer's vision plan.

  • Drug and Alcohol Testing – Safety-Sensitive Functions A. Employees required to have a Commercial Driver’s License (CDL) are subject to pre-employment, post-accident, random and reasonable suspicion testing in accordance with the U.S. Department of Transportation rules, Coast Guard Regulations (46 CFR Part 16) or the Federal Omnibus Transportation Employee Testing Act of 1991. The testing will be conducted in accordance with current Employer policy.

  • Safety Orientation All employees shall be certified in Safety Orientation. Safety Orientation shall consist of three parts: PART 1 - the CODC Interactive Rights and Responsibilities course; PART 2 - the XXXX course or equivalent, and PART 3 - Employer or Owner Project Specific Training. It is the responsibility of each employee to hold current certification and maintain certification in part 1 and Part 2. The Employer or Owner shall provide to each Employee before commencing work with PART 3 - Employer or Owner Project Specific Training. Each Employee shall be on the payroll and paid while receiving PART 3 training. As a condition of employment it is the sole responsibility of each and every employee to obtain, hold and maintain all current certification(s) in any and all legislated safety training requirements (i.e. WHMIS, Fall Arrest, etc.) that are trade specific. Supporting documentation of all legislated training must be provided by the employee to the Union prior to dispatch and to the employer upon hire and may be further requested by the employer at any time during the duration of their employment. Prior to the expiration of any certification, the Employer will notify the Employee of the pending expiration and give the Employee reasonable time to renew their certification. Further, prior to arriving at site, employees shall hold current qualification(s) for the specific tasks and equipment identified in the dispatch request. If the employee has to be trained after dispatch, all costs borne by the Employer shall be reimbursed by the Training Fund. The CODC Harassment Policy and Procedures, including the provisions regarding General Harassment and as amended from time to time shall be the minimum standard of this Agreement.
