Elimination of a Position. 30 When an employee’s position is eliminated, the employee may opt to be voluntarily placed in 31 layoff status pursuant to Section 15.5, or to use their seniority to bump into the position held by 32 the most junior employee in the classification with the same number of work hours; provided, 33 they are qualified for the position pursuant to Section 13.5.1. Should there be no junior 34 employee with the same number of work hours, the employee may bump the most junior 35 employee in substantially equal position [within one-half (½) hour.] Should there be no 36 substantially equal position, the senior employee may bump the most junior employee in a 37 position as closely matching in hours as possible in order for the senior employee to retain 38 work hours. The employee who has been bumped may then opt to use their seniority in the 39 same manner. The bumping procedure may not be used to increase work hours, or hourly rate 40 of pay. Increases in hours may be achieved through the bidding process for new or open 41 positions pursuant to Section 13.9. Employees who bump into a position are excluded from the 42 reassignment options in Section 14.2. In the event there are no remaining positions to bump 43 into, the employee shall be in layoff status and placed on a reemployment list pursuant to 44 Section 15.5.

Elimination of a Position. In the event it becomes necessary to eliminate a position, and the position elimination cannot be accomplished by furlough of the least senior employee, the affected employee has the right to bump the least senior person within the classification, provided he/she is qualified to do so. If more than one position within the classification is eliminated, the most senior person (affected by the position elimination) will have the right to choose a position from a list of the least senior employees within the classification, in accordance with the Seniority List. The number of positions from which to choose will equal the number of positions eliminated. The most senior person will be given first choice of positions and the process will continue until all senior employees have been placed. The affected employee shall be given fourteen (14) working days written notice of the said position elimination and an explanation of why this elimination has become necessary. Should the original position reopen, employee(s) affected by the elimination are to be reinstated into their former position, if they so desire.
