COLLECTION COSTS AND ATTORNEY FEES. Unless prohibited by applicable law, if you default, we can also require you to pay col- lection and court costs we actually incur in a collection proceeding, and a reasonable attorney’s fee if we refer your account for collection to an attorney.
COLLECTION COSTS AND ATTORNEY FEES. If you are in default under the terms of this Agreement, you agree to pay the Credit Union’s costs in enforcing this Agreement and collecting any amounts you owe. The Credit Union’s costs include, to the extent permitted by applicable law, reasonable attorney fees if the Credit Union hires an attorney, and legal expenses incurred whether or not a lawsuit is commenced, plus any court costs and all other reasonable sums allowed by law. Attorney fees and legal expenses include those related to bankruptcy proceedings (including efforts to modify or vacate any automatic stay), trials, appeals, and any anticipated post-judgment collection actions. You agree that all collection costs and attorney fees incurred by the Credit Union are secured in accordance with this Agreement.
COLLECTION COSTS AND ATTORNEY FEES. Lessee agrees to pay Lessor as additional rent all costs of collection and all attorney fees incurred by Lessor in enforcing the terms of this lease, including all such costs and fees incurred in any action for rent and possession of the premises. As consideration of this Lease, the Lessee further agrees to pay all attorney fees for Lessor in defending any suit brought by Lessee in the event a lawsuit is filed by Lessee for a refund of the deposit and Lessee does not recover substantially all of the sums prayed for in the lawsuit. LESSEE HEREBY AGREES TO WAIVE A JURY TRIAL IN SUCH CASE, AS PART OF THE CONSIDERATION OF THE SIGNING OF THIS LEASE. The undersigned understands and agrees that a collection fee of up to 40% of any defaulted balance will be added to the total amount due to the lessor should this account enter default and have to be placed with a third party collections firm for resolution.

Whether or not litigation or arbitration is commenced, Borrower promises to pay all costs of collecting any amounts which may become due to Lender under any of the Loan Documents. Without limiting the foregoing, if litigation or arbitration is commenced to enforce or construe any term of any of the Loan Documents, the prevailing party shall be entitled to recover from the other party all costs thereof, including but not limited to such sums as the court or arbitrator(s) may adjudge reasonable as attorney fees at trial, in any appellate proceeding, proceeding under the bankruptcy code or receivership and post-judgment attorney fees incurred in enforcing any judgment.

If Xxxxxx retains an attorney to collect payments due from Buyer, or to enforce or interpret any term of this document, Xxxxx agrees to pay, in addition to all other amounts due to Seller, Xxxxxx's collection expenses, court costs, and reasonable attorney fees incurred prior to and at trial, and on any appeal. If Seller refers the account to a collection agency, Xxxxx agrees to pay all costs, expenses, and attorney fees incurred by the collection agency in collecting payments due from Buyer.
