Attorney Fees/Costs. In the event of suit, action or arbitration is instituted to enforce any of the terms of this Agreement, the prevailing party shall be entitled to recover from the other party such sum as the court or arbitrator may adjudge reasonable as attorney fees, costs and all expenses of adjudication including but not limited to deposition costs, expert witness fees and other discovery cost incurred during the investigation arising hereunder, at hearing or trial or on appeal of such suit, action, or arbitration, in addition to all other sums provided by state or federal law, and by this Agreement.

Such costs and expenses shall be recoverable whether the services were rendered by a salaried employee of the party or by an independent contractor.
