Authority of City Manager. All work to be performed by the Consultant hereunder shall be performed to the satisfaction of the City Manager of the City of Xxxxxx. The City Manager (or designated authority) shall decide any and all questions, which may arise as to the quality, or acceptability of the work performed by the Consultant and the decisions of the City Manager in such cases shall be final and binding on both parties. However, nothing contained herein shall be construed to authorize the City Manager to alter, vary or amend this Agreement.
