The Owner maintains a Zero-Tolerance policy against SPAM, be it direct, third party or any affiliate (Recipient) or similar agent acting on the Recipient's behalf. As such, the Owner reserves the right to terminate any violating Recipient’s account or any part thereof, without notice or compensation. Any Recipient’s found to be involved in a SPAM/UCE campaign, including flooding newsgroups, distributing messages to recipients that do not want the information or any other abuse contravening UCE legislation will be met as follows:

All emails sent in connection with the Affiliate Program must include the appropriate party's opt-out link. From time to time, we may request - prior to your sending emails containing linking or referencing the Affiliate Program that you submit the final version of your email to Alfaleads for approval by sending it to your Alfaleads representative and upon receiving written approval from Alfaleads of your email the email may be transmitted to third parties. It is solely your obligation to ensure that your actions complies with the legislation.

FHP also prohibits using false headers in emails or falsifying, forging or altering the origin of any email in connection with FHP, and/or its products and services. Forever Healthy prohibits engaging in any of the foregoing activities by using the service of another provider, remailer service, or otherwise. If you or anyone you know is "spammed" by someone who is selling or describing Forever Healthy’s products and services, please contact us promptly so that we make take appropriate action.

The Company does not authorize, consent to, or condone the initiation (as “initiate” is defined in 15 U.S.C. § 7702(9)) by Affiliate of commercial electronic messages (as defined in 15 U.S.C. § 7702(2)) that refer to Company in any manner that are not specifically authorized within the scope of this Agreement. Affiliate agrees that commercial electronic messages initiated as part of the promotion of Company by Affiliate will be sent only to current customers of Affiliate who have given affirmative consent, as it is defined in 15 U.S.C. § 7702(1), to receive such emails, and that such emails are the only emails authorized under this Agreement. Affiliate agrees that all commercial electronic messages initiated by Affiliate as part of the promotion of Company will comply with the requirements of the CAN-SPAM Act (15 U.S.C. § 7701 et. seq.). Affiliate agrees to forward all SPAM-related complaints that arise out of the promotion of Company to Company at xxxx@XxxxXxxxxxXxxxxxx.xxx. Accordingly, Affiliate represents and warrants that Affiliate will not engage in the practice of sending unsolicited email messages and Affiliate hereby agrees to the following conditions:

The Recipient will be held accountable for any monetary damages suffered by the Owner, sustained through contravention of this Affiliate Program Agreement. This will include, but not limit to punitive damages related to lost clients and brand deterioration. CUSTOMER SERVICE The Owner will be responsible for handling all customer inquiries, product orders, customer billing and collection, product shipment relative to customers that enter the Owner’s site through the links from the Recipient’s site. Pricing of the Owner products and services is totally within its discretion and the Owner reserves the right to change the pricing structure, terminate any special offers, discontinue products or services, or change the terms under which products or services are offered at any time, without any advanced notice to the Recipient or users accessing the Owner’s site. The Owner’s only responsibility to the Recipient in this regard is to track customer orders that occur through links from the Recipient’s website and make reports to the Recipient of the commissions due to the Recipient as a result thereof. All such reports shall be un-audited. The Owner will have no obligation to provide the Recipient with any specific information relative to any customer, regardless of whether they access the Owner’s site through the link from the Recipient’s site.
