Recipient certifies that the conditions for use of the Data in conjunction with the Research Project have been reviewed by the Recipient's Institutional Review Board (IRB) or similar human subjects oversight body in accordance with Department of Health and Human Services regulations at 45 CFR Part 46.
The Core Partners will not assert ownership over any Intellectual Property invented, developed or created in the performance of an External Research Project (“External IP”), including projects that incorporate ExFAB Services, but only to the extent that there is no Core Partner employee providing ExFAB Services who is a co-inventor of such External IP as determined by applicable US intellectual property law.
The Awardee or the Institution’s department head will promptly notify the AHA if, for any reason, the Awardee will be absent longer than 60 days from the Research Project.
If the Principal Investigator (or co-investigator(s) if applicable) is absent from the Research Project and the AHA does not receive notice of such absence for a period of 60 days or longer, then the AHA may require the full repayment of the Award.
Liability: The AHA is not responsible for any claim, judgment, award, damages, settlement, negligence or malpractice arising from the Research Project or investigation related to this Award.
