Rectification Plan definition

Rectification Plan means the rectification plan pursuant to the Rectification Plan Process;
Rectification Plan means a plan agreed in accordance with clause 16 for the resolution of a Service Failure.
Rectification Plan a plan to address the impact of, and prevent the reoccurrence of, a Notifiable Default; “Rectification Plan Failure” (a) the Supplier failing to submit or resubmit a draft Rectification Plan to the Authority within the timescales specified in Clauses 28.4 (Submission of the draft Rectification Plan) or 28.8 (Agreement of the Rectification Plan); (b) the Authority, acting reasonably, rejecting a revised draft of the Rectification Plan submitted by the Supplier pursuant to Clause 28.7 (Agreement of the Rectification Plan); (c) the Supplier failing to rectify a material Default within the later of: (i) 30 Working Days of a notification made pursuant to Clause 28.2 (Notification); and (ii) where the Parties have agreed a Rectification Plan in respect of that material Default and the Supplier can demonstrate that it is implementing the Rectification Plan in good faith, the date specified in the Rectification Plan by which the Supplier must rectify the material Default; (d) a Material KPI Failure re-occurring in respect of the same Key Performance Indicator for the same (or substantially the same) root cause in any of the 3 Measurement Periods subsequent to the Measurement Period in which the initial Material KPI Failure occurred; (e) the Supplier not Achieving a Key Milestone by the expiry of the Delay Deduction Period; and/or (f) following the successful implementation of a Rectification Plan, the same Notifiable Default recurring within a period of 6 months for the same (or substantially the same) root cause as that of the original Notifiable Default;

Examples of Rectification Plan in a sentence

  • If such failure persists for more than [sixty (60)] days after an initial written notice from ESCo to the Developer of the Developer’s failure to carry out the relevant obligations under the Rectification Plan ESCo may perform, or procure that a third party performs, the relevant obligations under the Rectification Plan and the Developer shall be liable for ESCo’s reasonable Losses incurred when doing so.

  • If the Developer fails to carry out any of its obligations under the Rectification Plan within the timescales set out in the Rectification Plan, the Developer shall be liable for all reasonable Losses that ESCo incurs as a direct result.

  • If, within [twenty one (21)] days of receipt of the final Schedule of Non-Conformities, the Developer and ESCo do not agree a Rectification Plan, either Party may invoke the dispute resolution procedure in Clause 27 (Dispute Resolution Procedure).

  • Until the Developer has carried out its obligations under the Rectification Plan, ESCo shall be relieved from delivery of the Heat Supply and/or performing those elements of the ESCo Services that ESCo is reasonably prevented from carrying out until such obligations are performed.

  • Rectification Plan Within [fourteen (14)] days of ESCo providing the Developer with the final Schedule of Non-Conformities for the HIUs in accordance with paragraph 4.2.2 above, the Parties shall meet to mutually agree a Rectification Plan setting out the Non-Conformities and the agreed remedial works and/or actions that the Developer (or its agents) shall take in respect of the Non-Conformities, including any agreed time scales or other terms.


More Definitions of Rectification Plan

Rectification Plan means a plan agreed between ESCo and the Developer in accordance with the terms of this Schedule 8 setting out any agreed remedial works and/or actions in respect of the Non-Conformities in the [(i) the Energy Plant and Equipment, (ii) the Primary Distribution Network, and (iii) the Secondary Distribution Network].
