Complete Construction definition

Complete Construction or “Completion Date” shall mean the date upon which the Redeveloper receives a Certificate of Completion for the Project (or relevant Phase or portion thereof).
Complete Construction shall have the meaning set forth in Section 8.1.

Complete Construction means:
Complete Construction means that the County has confirmed that the roadway has been constructed in accordance with the approved plans for the Eastern Segment and is open to vehicular travel and the maintenance guarantee has been delivered to the COUNTY. Within sixty (60) days of the 100% design approval of the Eastern Segment by FDOT and the COUNTY, or within ninety (90) days of the County’s request, whichever occurs first, the Developer and WCL LANDOWNERS shall convey to the COUNTY, in accordance with section F.5. of this Restated D.A. (2011), any additional right of way or easements that are necessary for the construction of the Eastern Segment, including any right of way or easements needed for Roadway Appurtenances. The DEVELOPER shall coordinate the design and permitting of the Eastern Segment with the owners/developers of the Wyndfields MPUD to ensure that S.R. 56 from Meadow Pointe Boulevard to Wyndfields Boulevard is designed and permitted as a unified roadway segment, and in accordance with the previously approved PD&E, and other FDOT requirements.
Complete Construction or "Completion of Construction" means, for any Eligible Improvement, construction acceptance in accordance with the Town Requirements, applicable laws, ordinances, and regulations of the Town and any other governmental entity or public utility with jurisdiction, subject to any applicable conditions of maintenance and warranty, including, without limitation, the issuance of a certificate of occupancy by the Town so that the Eligible Improvement described in such certificate may open for permanent occupancy and utilization for its intended purposes. "Costs of Issuance" means, collectively, the reasonable and necessary costs incurred in connection with the issuance of the District Bonds, including, without limitation, underwriter's compensation, financial consultant fees, fees and expenses of bond counsel, counsel to the underwriter, and counsel to any party or entity from which an opinion of counsel is required (other than the Town), fees and expenses of any provider of credit enhancement, bond insurance, or guaranty, fees and expenses of the District Bond Trustee, bond registrar, paying agent, and transfer agent and rating agency fees, provided that the Costs of Issuance that may be paid from the proceeds of the District Bonds shall not exceed the following maximum percentages of the principal amount of the applicable series of the District Bonds, depending on the par amount of the applicable series of the District Bonds, without the written consent of the Town: for District Bonds up to Fifteen Million ($15,000,000), the maximum percentage shall be 4%; for District Bonds between Fifteen Million ($15,000,000) and Twenty Five Million ($25,000,000), the maximum percentage shall be 3.75%; and for District Bonds in excess of Twenty Five Million ($25,000,000), the maximum percentage shall be 3.5%. Town Costs and Pre-Financing Costs may be paid from the proceeds of the District Bonds, but for purposes of calculating the maximum Costs of Issuance that are payable from proceeds of the District Bonds, Town Costs and Pre-Financing Costs shall not be included in the calculation of Costs of Issuance.
Complete Construction. (and any variation thereof) means, as applicable, that: (i) a specified scope of work has been completed in accordance with the plans and specifications thereof, including those elements of the Construction Documents for which approval is required pursuant to the Vertical Design Review and Document Approval Procedure; (ii) public agencies with jurisdiction have issued all permits, licenses, approvals, Certificates of Occupancy and other sign-offs required for the contemplated use and occupancy of the scope of work; (iii) the site has been cleaned and all equipment, tools and other construction materials and debris have been removed; (iv) all bills for the scope of work have been paid, any surety has consented to final payment, all recorded mechanics’ liens have been removed (by bonding or otherwise) and the period for recording mechanics’ liens has expired; and (v) all as-built plans and warranties, guaranties, operating manuals, operations and maintenance data, certificates of completed operations or other insurance, and all other close-out items required under the pertinent construction contract, have been provided to the Agency.
Complete Construction means the point at which Residential Units have been completed in accordance with approved plans and specifications, as reasonably determined by Agency, and a Certificate of Occupancy has been issued for such Residential Units.
Complete Construction means the completion of construction work to a degree that functional use of the Holding Tank or IAS is achieved.
