Subpart C. Miscellaneous Provisions CORPORATE FELONY CONVICTION AND FEDERAL TAX LIABILITY ASSURANCES As required by Pub. L. No. 113-6, this clause applies to Prime Recipients that are corporations. By entering into this agreement, the Prime Recipient attests that it has not been convicted of a felony criminal violation under Federal law in the 24 months preceding the date of signature. By entering into this agreement, the Prime Recipient attests that none of its agents or officers have been convicted of a felony offense, arising out of actions for or on behalf of the corporation, under Federal law in the 24 months preceding the date of signature. The Prime Recipient further attests that it does not have any unpaid Federal tax liability that has been assessed, for which all judicial and administrative remedies have been exhausted or have lapsed, and that is not being paid in a timely manner pursuant to an agreement with the authority responsible for collecting the tax liability. NON-ASSIGNABILITY This Award may not be transferred, assigned, or assumed, by operation of law or otherwise, without the prior written consent of the DOE Contracting Officer. Environmental, Safety and Health Performance of Work at DOE Facilities‌ With respect to the performance of any portion of the work under this Award which is performed at a DOE -owned or controlled site, the Recipient agrees to comply with all State and Federal Environmental, Safety and Health (ES&H) regulations and with all other ES&H requirements of the operator of such site. Prior to the performance on any work at a DOE-owned or controlled site, the Recipient shall contact the site facility manager for information on DOE and site specific ES&H requirements. The Recipient is required apply this provision to its subrecipients and contractors.

  • Non-discrimination Based on National Origin as evidenced by Limited English Proficiency The Contractor agrees to comply with the non-discrimination requirements of Title VI of the Civil Rights Act of 1964, 42 USC Section 2000d, et seq., and with the federal guidelines promulgated pursuant to Executive Order 13166 of 2000, which require that contractors and subcontractors receiving federal funds must assure that persons with limited English proficiency can meaningfully access services. To the extent the Contractor provides assistance to individuals with limited English proficiency through the use of oral or written translation or interpretive services in compliance with this requirement, such individuals cannot be required to pay for such services.
