SHIPMENT; TITLE; RISK OF LOSS a. After acceptance by Xxxxxxx, no order may be canceled or modified without Norweco’s prior written approval. Title to, and risk of loss in, the products shall pass to Purchaser at Norweco’s plant and/or facilities upon loading of the products onto the carrier by mode of transportation designated herein at the tariff rates in effect at the time of Norweco’s acceptance. Increases in tariffs or fuel surcharges shall be on your account on transportation charges. Seller has the right to discontinue or alter any model or design of its equipment or products regardless of the model or design covered within this proposal and to substitute, therefore, a new and equal or better product that shall conform to the product requirements set forth in this Agreement.
SHIPMENT; TITLE; RISK OF LOSS. For shipments within the United States, Itron will ship Equipment FOB Origin, production facility. Customer must pay for all costs associated with delivery of Equipment to the final destination. Title and risk of loss of Equipment will pass to Customer upon tender to the carrier at the production facility. For shipments outside the United States, Itron will ship Equipment FCA Origin (Incoterms 2010). Equipment will be delivered export cleared to Customer at the production facility. Customer will act as the Importer of Record (IOR) for Equipment and assumes all costs associated with delivery of Equipment to the final destination, including transportation after delivery to carrier and any licensing, certifications, permits, customs fees, import/local taxes, provincial/national tax, and value added tax related to importation of Equipment. Itron will provide all necessary information required for Customer to import Equipment. Title to and risk of loss for Equipment passes to Customer upon tender to the carrier at the production facility.
SHIPMENT; TITLE; RISK OF LOSS. Unless expressly agreed otherwise, all prices and terms of sale are: (a) EXW AMI’s facility (Incoterms 2010) for domestic shipments, and (b) CIF named port of destination (Incoterms 2010) for international shipments. Title and risk of loss for Products transfers to Buyer per the applicable Incoterms 2010 rules. All quoted delivery dates and/or periods are approximate. AMI reserves the right to make delivery in installments, and delay in delivery of any installment shall not relieve Buyer of its obligation to accept remaining deliveries. All back orders will receive prompt consideration by AMI for completion as soon as is commercially practical. Claims for shortages, errors in delivery or other Product defects must be made in writing to AMI within 10 calendar days after receipt of shipment, and failure to give such notice shall constitute unqualified acceptance and a waiver of all such claims by Buyer. AMI shall not be liable for any damage or loss resulting from delays due to a cause beyond AMI’s reasonable control, including but not limited to an act of God, weather (including earthquake, tornado, fire, hurricane and/or flood), act of Buyer, embargo or other governmental act, regulation or request, accident, strike, slowdown, war, riot, pandemic, delay in transportation or inability to obtain necessary labor and/or materials. In the event of any such delay, the date of delivery shall be extended for a period equal to the time lost by reason of the delay.

SHIPMENT; TITLE; RISK OF LOSS. C2.4.1 In response to AMD's purchase orders, IBM will prepare MATERIALS for shipment to AMD using IBM designed packaging materials. AMD's purchase order will be referenced on the package exterior. Shipment will be F.O.B. IBM's designated factory shipping dock, or at such other suitable location that IBM selects, where AMD or its duly authorized representative will take title and arrange prompt delivery to AMD's carrier of choice. SHIPMENT; TITLE; RISK OF LOSS. 11.1 Except where otherwise agreed in writing, shipping terms shall be FCA (Xilinx Designated Location) (INCOTERMS 2000), and Distributor shall pay all applicable freight, insurance, duties, and import charges for delivery of the Product from the Xilinx Designated Location to the location specified by Distributor. Products shipped to the United States will be FOB (Xilinx Designated Location) within the United States. Distributor shall have the right to designate the common carrier to which Xilinx shall tender the Product at the Xilinx Designated Location, and, in absence of such specification by Distributor, Xilinx shall select the carrier in its reasonable discretion.
SHIPMENT; TITLE; RISK OF LOSS. Products Pulled pursuant to the terms of this Agreement shall be shipped F.C.A. Warehouse (Incoterms 2010), at which time title and risk of loss shall pass to Customer. Customer shall select the carrier. All freight, insurance, and other shipping expenses, as well as expenses for any special packing requested by Customer, shall be paid by Customer.
