SEP Oversight. The Rose Foundation will oversee SEP implementation in lieu of Regional Water Board staff oversight. The Discharger shall not have any implementation or oversight role for the SEP. The Rose Foundation’s oversight costs are included in the direct costs of the SEP as allowed under section VIII.G. of the SEP Policy since the SEP directly benefits disadvantaged communities. Oversight costs are within the 10 percent limit for SEPs performed by third party administrators. (SEP Policy, section VIII.G.)

SEP Oversight. The City of Xxxxxx Public Works Department will implement the Calas Park Stormwater SEP on behalf of the Discharger. The Los Angeles Water Board will provide additional oversight of the Calas Park Stormwater SEP, which includes, but is not limited to, updating regulatory and records databases, reviewing and evaluating progress, conducting site inspections, reviewing the final completion report, and verifying appropriate expenditure of the SEP Amount.
SEP Oversight. SFEI will oversee SEP implementation in lieu of Regional Water Board staff oversight and will report solely to the Regional Water Board. The Discharger shall not have any implementation or oversight role for the SEP; rather, all its obligations with respect to the SEP will be completed upon SFEI’s receipt of the SEP Amount and SFEI’s written notification described in section III, paragraph 2. SFEI has agreed to voluntarily cover any SEP related oversight costs. Oversight costs are not included in the SEP Amount.

Oversight tasks to be performed by the San Francisco Estuary Partnership include but are not limited to, updating CIWQS, reviewing and evaluating progress, reviewing the final completion report, verifying completion of the project with a site inspection, auditing appropriate expenditure of funds, and providing updates to Regional Water Board staff.

Reasonable oversight tasks to be performed by the Regional Water Board include but are not Order R1-2018-0016 - 5 - Stipulated Administrative Civil Liability Order City of Eureka, Elk River WWTF limited to, reviewing and evaluating progress, reviewing the final report, and verifying completion of the SEP.

The Lahontan Water Board will provide additional oversight of the Trout Creek SEP which includes, but is not limited to, updating regulatory and records databases, reviewing and evaluating progress, conducting site inspections, reviewing the final completion report, and verifying appropriate expenditure of the SEP Amount. The Dischargers are responsible for any charged costs for any reasonable and necessary Lahontan Water Board staff oversight, which is not included in the SEP Amount.
SEP Oversight. The City agrees to pay the San Francisco Estuary Partnership (SFEP) for costs for overseeing implementing the SEP, with check(s) payable the to the Association of Bay Area Governments. The City is solely responsible for paying for all oversight costs incurred by the San Francisco Estuary Partnership to oversee the SEP, up to a maximum of $20,000. The total oversight costs for the SEP are estimated to be $8,778. The SEP oversight costs are in addition to the total administrative civil liability imposed against the City and are not credited toward the City’s obligation to implement and complete the SEP as described in this Stipulation and Order. Oversight tasks to be performed by the San Francisco Estuary Partnership include but are not limited to, updating CIWQS, reviewing and evaluating progress, reviewing the final completion report, verifying completion of the SEP with a site inspection, auditing appropriate expenditure of funds, and providing updates to Regional Water Board staff.

SEP Oversight. The Discharger shall reimburse the Regional Water Board for its costs in overseeing the implementation of the SEPs. The Discharger shall pay the Cleanup and Abatement Account the amount for these costs within thirty (30) days of receipt of a statement from the Regional Water Board indicating the amount of oversight costs it has incurred. The oversight costs will be billed at the rate of $150 per hour. Further, the Discharger and the Implementing Party shall allow Regional Water Board staff to enter and/or inspect the SEP during normal business hours (i.e., 8 a.m. through 5 p.m.). At this time, Regional Water Board staff does not aniticipate any significant costs for overseeing this SEP project.

The Discharger shall not have any implementation or oversight role for the Tree Planting SEP. The Los Angeles Water Board agrees to provide the Discharger with a copy of the contract between the Rose Foundation and the SEP Implementing Party within five (5) business days of receipt from the Rose Foundation. The Rose Foundation’s oversight costs are included in the direct costs of the SEP as allowed under section VIII.G. of the SEP Policy since the Tree Planting SEP directly benefits disadvantaged communities. Oversight costs are within the ten (10) percent limit for SEPs performed by third party administrators. (SEP Policy, section VIII.G.)
