Obligation to Implement. The Customer shall be obliged to implement Maintenance Releases without undue delay. If not explicitly provided otherwise in this Agreement or explicitly agreed otherwise by the parties, Customers right to use shall cease if (i) the System in use is older than one year and (ii) Maintenance Releases have been provided to the Customer within that period.
